HomeMy Public PortalAbout029-1978 - Zoning - R-3 To C-2 - 117 S. 7th StAMENDED ORDINANCE NO. 29-1978 AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. WHEREAS, the Zoning Map which is part of Ordinance No. 2325-1968, designates and describes as R-3 One -to -Eight Family Resi- dence District, the following described property located at 117 South 7th Street in the City of Richmond, Indiana, more particularly described as follows: Lot Number 27 in Abraham Phillip's Addition to the City of Richmond SECTION 2. WHEREAS, it is the intent and purpose hereof to change the zoning classification on the above described area from R-3 One -to -Eight Family Residence District to C-2 Community Business District, and, SECTION 3. WHEREAS, a study of this Ordinance was conducted by the Rich- mond City Plan Commission the 27th day of June, 1978, at which time remonstrances were heard from all parties interested in or affected by this Ordinance. SECTION 4. WHEREAS, the vote of the Richmond City Plan Commission was six (6) to one (1) in favor of recommending the passage of Amended Ordi- nance No. 29-1978. NOW THEREFORE: SECTION 5. It is hereby ordained that the zoning classification of the above described property be, and the same is hereby changed to C-2 Community Business District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana, and all amendments thereto. SECTION 6. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. SECTION 7. The original zoning classification of the aforementioned area is hereby rescinded and the zoning classification of this area will be in accordance with Section 2 of this Ordinance. ATTEST: City Clerk 50 North Fifth Street RICHMOND, INDIANA 47374 June 29, 1978 Ms. Thomas Austerman, President Members of Common Council & Mrs. Jo Ellen Trimble, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 29-1978 Plan Commission Case PC-78-9 Dear Mr. Austerman, Members of Common Council and Mrs. Trimble: The Richmond City Plan Commission held a public hearing on June 27, 1978, on the petition of Raymond Knoll, 111 South 'th Street; re- questing to rezone Lots 27 and 28 in Abraham Phillips Addition, more commonly known as 117 and 123 South 7th Street, from R-3 One - to -Eight Family Residence District to C-2 Community Business Dis- trict. Lot 27, 117 South 7th Street, is the location of the Social Security Administrative Offices and is a use that would properly be placed in the C-2 Zoning District. Lot 28, 123 South 7th Street, is presently a residence; petitioner is proposing to remove the building for the purpose of constructing an off-street parking area for the Social Security building. The petitioner represented the request and three (3) persons spoke . in opposition. Sixteen (16) letters had been sent to adjoining pro- perty owners; none were returned in _favor or opposition. The Plan Commission voted six (6) to one (1) to recommend that Ordi- nance No. 29-1978 be amended by deleting Lot 28 from the requested rezoning; the reason being that the petitioner could establish the proposed accessory off-street parking facility on Lot 28 by means of a special use in the R-3 Zoning District, and this could have less an impact on the surrounding neighborhood than a change in the zoning to the C-2 District.
