A RESOLUTION ACKNOWLEDGING COMPLIANCE WITH A
CERTAIN REQUIREMENT OF SECTION 4.08 OF TIFFIN
SUBDIVISION ORDINANCE NO. 218 BY THE
OWNER/ SUBDIVIDER OF TIFFIN INDUSTRIAL PARK, A
SUBDIVSION OF TIFFIN, IOWA.
WHEREAS, the City of Tiffin entered into a Subdivider's Agreement, with
the Iowa City Excavating & Grading, Inc., the Subdivider/Owner of Tiffin
Industrial Park, a subdivision of Tiffin, Iowa, dated January 14, 2004, recorded
November 18, 2004, in Book 3816, Page 823, records of the Recorder of
Johnson County, Iowa,
WHEREAS, the Subdivider's Agreement made provision for the deferral of
the Tiffin Subdivision Ordinance No. 218, Section 4.08, which requires that five
percent of the total land in a proposed subdivision be dedicated as "a park and
open space"; and
WHEREAS, the Subdivider's Agreement provided that in return for the
deferral of the open space, the Subdivider/Owner must install storm sewer
culverts near the wastewater treatment plant, as specified by the City Engineer;
and
WHEREAS, the Subdivider's Agreement provided that upon completion of
satisfactory installation of said culverts by the Subdivider/Owner, the City
would acknowledge full compliance of any requirement of public or open space;
and
WHEREAS, City Engineer, Michael W. Hart, has examined the
installation of the storm water culverts and finds the work to be satisfactory
and recommends approval of the installation to the City Council;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of Tiffin,
Iowa, that the subdivision known as Tiffin Industrial Park, Tiffin, Iowa, is
hereby released from the requirements of an "open space" as specified in
Section 4.08 of the Tiffin Subdivision Ordinance No. 218.
ON THE 10thday of October 2007, at a (regular/ special) meeting of the
Tiffin City Council, Tiffin, Iowa, Councilperson E,4:4:, introduced A

REQUIREMENT OF THE TIFFIN SUBDIVISION. ORDINANCE NO. 218 BY
THE OWNER/SUBDIVIDER OF TIFFIN INDUSTRIAL PARK, A SUBDIVSION
OF TIFFIN, IOWA, and made a motion for approval. The motion was seconded
by Councilperson Wr i gh t -
Ayes• Wright, Dils, Demuth, Petersen, and Bartels
Nays: None
Motion carried.
WHEREUPON, the Mayor declared that the RESOLUTION
ACKNOWLEDGING COMPLIANCE WITH A CERTAIN REQUIREMENT OF
THE TIFFIN SUBDIVISION ORDINANCE NO. 218 BY THE
OWNER/ SUBDIVIDER OF TIFFIN INDUSTRIAL PARK, A SUBDVVSION OF
TIFFIN, IOWA, be adopted and signified his approval of the same by affixing
his signature thereto.
PASSED, by the Council on the 1 nt-day of mart-nher 2007, and
approved by the Mayor on the 1 ()thday of-Qete�er 2007.
