HomeMy Public PortalAbout2006_02_28_r033 The Town of Leesburg, Virginia PRESENTED February 28. 2006 RESOLUTION NO. 2006-33 ADOPTED February 28.2006 A RESOLUTION: RATIFYING THE ATTACHED TOWN/OAKLAWN AGREEMENT AS SOLE SOURCE PROCUREMENT WHEREAS, the Council of the Town of Leesburg in Virginia originally approved the Town/Oaklawn Agreement by Resolution 2005-44; and WHEREAS, the Town/Oaklawn Agreement is a sole source procurement; and WHEREAS, the sole source nature of the agreement is tied directly to Oaklawn being the only developer that owns all of the undeveloped property on the west side of Sycolin Road between the Stratford development and Tolbert Lane; and WHEREAS, the property is currently approved for development and in turn Oaklawn has interest in completing this section of Sycolin Road; and WHEREAS, the Town/Oaklawn Agreement also allows our Town CIP project to move forward on an accelerated path which benefits the residents ofthe SW quadrant of Town; and WHEREAS, this agreement allows more efficient use of tax dollars by not requiring the developer to build improvements that would ultimately be removed with the Town's CIP project; and WHEREAS, the agreement was also proposed to enable the use of developer dollars towards the ultimate road configuration; and WHEREAS, the Sycolin Road at Battlefield Parkway intersection construction is coordinated with the Greenway interchange, the Oaklawn interior roadways, and land bay development; and WHEREAS, in accordance with the Town/Oaklawn Agreement, Oaklawn solicited - 2 - A RESOLUTION: RATIFYING THE ATTACHED TOWN/OAKLAWN AGREEMENT AS SOLE SOURCE PROCUREMENT construction bids for the Sycolin Road Widening Phase I project; and WHEREAS, four bids were received and read aloud on January 31,2006; and WHEREAS, the following bidders submitted bids: KB Contracting, Inc. Tessa Construction & Tech Company, LLC Shirley Contracting Hazel Construction $4,641,294.95 $4,921,439.58 $4,986,732.50 $5,139,282.55; and WHEREAS, the bid award is part of the TownlOaklawn Agreement, Oaklawn may award the construction contract without a contract award resolution for Town Council; and WHEREAS, there are sufficient funds available for the construction of the Sycolin Road Widening Phase I. THEREFORE, RESOLVED, by the Council ofthe Town of Leesburg in Virginia as follows: SECTION I. That the Town Council ratifys the TownlOaklawn Agreement as a sole source procurement.
