HomeMy Public PortalAbout2006_02_28_r035 The Town of Leesburg, Virginia PRESENTED: FEBRUARY 28. 2006 RESOLUTION NO. 2006-35 ADOPTED: FEBRUARY 28, 2006 A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2006-0001 ENTERPRISE RENT-A-CAR 25 FAIRFAX STREET, S.E., TO PERMIT VEHICLE RENTAL IN THE B-2 ZONING DISTRICT WHEREAS, Enterprise Leasing Company has requested a Special Exception to permit vehicle rental; and WHEREAS, the property is located in the B-2 Established Corridor Commercial Zoning District; and WHEREAS, on January 10, 2006 the Town Council authorized ajoint public hearing with the Planning Commission with adoption of Resolution 2006-12 and WHEREAS, on February 28, 2006, the Town Council held a joint public hearing with the Planning Commission; and WHEREAS, the proposed use complies with the Town Plan, and the proposed use meets the special exception standards for a vehicle rental facility as set forth in the Zoning Ordinance;, and WHEREAS, staff recommends approval. WHEREAS, The Council has concluded that the approval of the application would be in the public interest and in accordance with sound zoning and planning principles. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: Special Exception application TLSE-2006-0001, Enterprise Rent-A-Car, 25 Fairfax Street, S.E., identified in the Loudoun County Land Records as Parcel Identification Number 231-17 -7713 is hereby approved with the following conditions: -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2006-0001 ENTERPRISE RENT-A-CAR 25 FAIRFAX STREET, S.E., TO PERMIT VEHICLE RENTAL IN THE B-2 ZONING DISTRICT Substantial Conformance: 1. Development of this special exception use shall be in substantial conformance with the Enterprise Rent-A-Car Special Exception Plat (plat) dated 12/27/05, revised 02/21/06 prepared by Urban Engineering & Associates, Inc. No Implied Waivers: 2. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except as specifically approved by Town Council or as shown as approved by Town Council on the Special Exception Plat and supporting documents. Required Permits: 3. All required permits, including but not limited to zoning permit and business license, shall be obtained prior to operation of the vehicle rental use at Virginia Village Shopping Center. ParkingILoading: 4. No vehicles except passenger vehicles shall be parked at this site. Cargo vehicles shall be prohibited. A note shall be added to the Plat to this affect. 5. No more than 20 rental vehicles shall be kept on the premises at any given time. 6. No vehicle maintenance, washing, or repair shall be performed on site. A note shall be added to the Plat to this affect. 7. The 20 designated rental vehicle parking spaces depicted on the Special Exception Plat shall be identified as parking for Enterprise by painted pavement markings. 8. Rental vehicles shall only be parked in the 20 designated parking spaces. No rental vehicles shall be parked outside of these demarcated spaces. A note shall be added to the Plat to this affect. Landscaping: 9. One new 145 square-foot landscape island per Zoning Ordinance Section 12.6.3. shall be installed at the south end of the 20-space rental car parking bay that better defines the limits of the required parking and assists with defining the traffic circulation in that area of the parking lot. Miscellaneous Details: 10. The Plat shall correct the inconsistencies in the dimensions depicted thereupon: The Plat depicts a row of parking that measures 20' x 9', these spaces only measure 18' x 9' on -3- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2006-0001 ENTERPRISE RENT-A-CAR 25 FAIRFAX STREET, S.E., TO PERMIT VEHICLE RENTAL IN THE B-2 ZONING DISTRICT the Plat. The parking lot drive aisles are dimensioned in correctly, the 26' aisle measures 24' on the plat, and the 24.5' aisle measures 26' on the Plat. 11. The Plat shall depict the location of the five unidentified parking spaces required for employee/customer parking. PASSED this 28th day of February, 2006.
