AN ORDINANCE TO APPROPRIATE FROM LOCAL ROAD AND STREET -SPECIAL DISTRIBUTION FUND.
WHEREAS, extraordinary and direct costs were incurred as a result of snow
removal operations during 1978,
WHEREAS, Senate Bill No. SEA219 was passed by the Indiana State Legislature
and signed by the Governor of the State of Indiana which became effective
April 1, 1978,
WHEREAS, Senate Bill SEA219 amends Indiana Code 1C8-14-2 which provides for
a one-time lump sum payout of the monies in the City of Richmond's Local
Road and Street Account,
WHEREAS, Senate Bill SEA219 allows these funds to be used to pay or reimburse
"extraordinary and direct costs incurred as a result of snow removal operations
during 1978, including reimbursements for labor, snow removal equipment, snow
removal equipment repairs, materials required to remove ice and snow;'
WHEREAS, Indiana Code 1C10-4-1, Section 7 and Section 10 allows a municipality
to expend unappropriated funds without prior appropriation during an emergency
situation, which did exist due to the blizzard of 1978,
WHEREAS, the President of the United States declared Indiana a disaster area
arising from the blizzard of 1978,
WHEREAS, Extraordinary and direct costs incurred as a result of snow removal
operations, it is now necessary to appropriate more money for the various
functions of the Motor Vehicle Highway Department to reimburse for the snow
removal operations.
NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL IN THE CITY OF RICHMOND,
INDIANA.
SECTION 1. That for the expenses of the City Government and its institutions
for the year ending December 31, 1978, the following amount of money is hereby
appropriated and set apart out of the fund named and for the purpose specified,
said sum being subject to the law governing the same. Such amount appropriated
shall be held to include all expenditures to be made during the year unless
expressly stipulated by law.
SECTION 2. That for the said fiscal period there is hereby appropriated from
the Local Road and Street Special Distribution Fund the following specified amount
to meet the extraordinary emergency hereby declared to exist.

SECTION 3. This Ordinance shall be in full force and effect from and after its
passage and approval by the Mayor and is subject to the laws of the State of
Indiana governing emergency appropriations.

This ordinance is self-explanatory, however, I would like to point
out that the total cost of the contractors, Other Contractual
Services, totaled $39,304.50. We have been reimbursed by the
Federal Government in the amount of $12,039.00. This was
appropriated, as you will recall, on Ordinance 21-1978.

COUNCIL OF THE CITY OF RICHMOND, [NDIANA
The Common Council of the City of Richmond, Indiana, met in regular session in the
Council Chambers in the Municipal Building of said. City May 15, 1978
at the hour of 7:30 D.M.
Councilman Austerman presided with the following members present:

The Clerk presented proof of publication of Notice to Taxpayers printed in the
Richmond Palladium Item, a newspaper of general circulation in the City of
Richmond, Indiana, on the dates of May 3rd and May loth
Said notices stated that a public hearing would be held on the 1 th day of
May, 1978 , by the Common Council to consider additional appropria-
tions as provided for in Ordinance No. 32-1978 , within the City of
Richmond, Indiana. The proof of publication and posting of notices were examined
and found to be correct and in order. Councilman Mills moved the
proof of publication and posting of notices be received and ordered filed,
seconded by Councilman Welch and on voice vote the motion was
carried.

The additional appropriations as finally made will be referred to the State
Board of Tax Commissioners, which Board, upon receipt, will hold a further
hearing within fifteen days at the County Auditor's Office of said County,
or at such other place as may be designated. At such hearing taxpayers
objecting to any of such additional appropriations may be heard. Interested
taxpayers may inquire of the County Auditor when and where such hearing
will be held.
