Home My Public Portal About034-1978 - Amend Master Plan to include a two mile fringe area13 FADE 13 GENERAL ORDINANCE NUMBER 34-1978 AN ORDINANCE TO AMEND GENERAL ORDINANCE NUMBER 2282-1967 AS AMENDED TO AMEND THE MASTER PLAN OF THE CITY OF RICHMOND TO INCLUDE A PART OF THE TWO (2) MILE FRINGE AREA THEREOF WHEREAS, the Common Council of the City of Richmond, Indiana, did on the 8th day of August, 1967, pass and adopt an ordinance known as "Public Development Plan" and same was approved by the Mayor, Edward L. Cordell; and, being Ordinance Number 2282-1967; and, WHEREAS, said Ordinance Number 2282-1967 in Section Number Two (2) thereof state that the "Public Development Plan" shall be also the "Master Plan" of said city as referenced to in the Acts of the State of Indiana of 1947 - Chapter 174 as amended; and, WHEREAS, pursuant to said act the City of Richmond, did include in its "Master Plan" a fringe area outside the then corporate limits of said City; and, WHEREAS, Wayne County subsequent to August 8, 1967, adopted a Master Plan and thereby, according to the above said Acts of 1947, Chapter 174, removes` the "fringe area" from the jurisdiction of the Planning Commission of the City of Richmond; and, WHEREAS, said Act of 1947, Chapter 174, has now been amended to permit Cities in counties of less than eighty-four thousand (84,000) population to reassert jurisdiction of a denominated fringe area, same being IC 1971 18-7-5-34; and, WHEREAS, IC 1971, 18-7-5-34 authorizes a City to develop a Master Plan and Ordinance, and include therein all or any part of the area outside the corporate limits of said City which is within two (2) miles of the corporate limits of said City; and, WHEREAS, IC 1971, 18-7-5-44 authorizes the amendment of a Master Plan and Ordinance by the City Council of Richmond, Indiana; and, WHEREAS, the City Planning Commission has prepared an amendment to the City of Richmond Master Plan and an Ordinance implementing said plan; and, WHEREAS, the amendment to said Master Plan is shown on a map attached hereto and marked Exhibit "A" hereof and by reference made a part hereof; and, WHEREAS, the Planning Commission of the City of Richmond has given notice of a public hearing on the adoption of said amendment to the Master Plan and Ordinance; and, WHEREAS, ten (10) days after said notice a hearing was held; and, WHEREAS, after said hearing the Planning Commission of the City of Richmond did by resolution adopt said amendment to the Master Plan_. and Ordinance and cause the map - Exhibit "A" hereof, to be made a part of said Master Plan, and the vote herein being, Aye Six (6) Nay Zero (0) ; and, WHEREAS, said amendment to Master Plan (map) and a copy of the pro- posed Ordinance has been certified to City Council of the City of Rich- mond; and, WHEREAS, the Secretary of the Planning Commission of the Citv of Richmond has presented same to the City Council of the City of Richmond. C?�H 13- PAGE 14 NOW THEREFORE be it ordained by the Common Council of the City of Richmond, Wayne County, Indiana, that: Section 1. The Common Council of the City of Richmond, Indiana, finds that the two (2) mile fringe area surrounding said City is related to the orderly development of the City of Richmond, Indiana. Section 2. It is hereby deemed to be in the best interests of the City of Richmond that the so called two (2) mile fringe area be included in the Master Plan of the City of Richmond, Indiana to achieve such orderly development. Section 3. The purpose of this Ordinance is to assume jurisdiction under the Master Plan of the City of Richmond, Indiana of the two (2) mile fringe area and such jurisdiction as herein set out is hereby assumed and exercised. Section 4. The area as shown on the map attached hereto as Exhibit "A" hereof shall be designated as the two (2) mile fringe area covered by this amendment to the Master Plan of the City of Richmond as authorized by IC 18-7-5-34 - 18-7-5-44. Section 5. The Planning Commission of the City of Richmond shall in one hundred eighty (180) days prepare a zoning ordinance compatible with the best use and development of the area included in said Master Plan, as set out in the map, Exhibit "A" hereof. Section 6. This Ordinance shall amend Ordinance 2282-1967 as amended and shall become a part of chapter twenty-five (25) of the Municipal Code of the City of Richmond and shall and does hereby repeal all Ordinances or sections of Ordinances which are in conflict herewith. Section 7. This Ordinance and Master Plan shall be in full force and effect on passage and adoption by the Common Council of the City of Richmond and published as required by law. Mayo r ATTEST: C i tYKQerk RESOLUTION NO. 2-1978 A RESOLUTION OF THE RICHMOND CITY PLAN COMMISSION ADOPTING AN AMENDMENT TO THE MASTER PLAN FOR THE CITY OF RICHMOND, INDIANA TO INCLUDE A PART OF THE TWO (2) MILE FRINGE AREA THEREOF AND AN ORDINANCE FOR ITS ENFORCEMENT WHEREAS, IC 1971, 18-7-5-34 authorizes a City to develop a Master Plan and Ordinance, and include therein all or any part of the area outside the corporate limits of said City which is within two (2) miles of the corporate limits of said City; and, WHEREAS, IC 1971, 18-7-5-44 authorizes the amendment of a Master Plan and Ordinance by the City Council of Richmond, Indiana; and, WHEREAS, the Richmond City Plan Commission has prepared an amend- ment to the City of Richmond Master Plan and an Ordinance implementing said plan; and, WHEREAS, the amendment to said Master Plan to include such designated contiguous unincorporated area within two (2) miles of the corporate limits of the City is shown on a map attached to Ordinance No. 34 -1978 and marked Exhibit "A" thereof and by reference made a part thereof; and, WHEREAS, the Richmond City Plan Commission has given notice of a public hearing on the adoption of said amendment to the Master Plan and Ordinance; and, WHEREAS, ten (10) days after said notice a hearing was held; and, WHEREAS, during the conduct of this public hearing the Richmond City Plan Commission was satisfied that the amendment to the Master Plan, as presented, successfully met the needs and future requirements of the City of Richmond, Indiana and the designated contiguous unincorporated area within two (2) miles of the corporate limits and that no question raised as to any specific point remained unanswered, or was not satisfactorily answered. NOW THEREFORE BE IT RESOLVED that the Richmond City Plan Commission hereby endorses, adopts and certifies the amendment to the Master Plan and the Ordinance for its enforcement, said Ordinance being Exhibit "A" of this Resolution, and which amendment is hereby declared to establish and to conserve and promote the public health, safety and general welfare of the City of Richmond, Indiana and the designated contiguous unincorporated area within two (2) miles of the corporate limits of the City all pursuant to IC 1971, 18-7-5-1 thru 99; and, BE IT FURTHER RESOLVED that a certified copy of the approved amend- ment to the Master Plan and a recommended Ordinance for its enforcement be respectfully transmitted to the honorable Common Council of the City of Richmond, Indiana for considera- tion and the Planning Director is hereby ordered to execute such documents and take such action as prescribed by IC 1971, 18-7-5-34 thru 44 to implement the purpose of this Resolution. The amendment adopts the City of Richmond's Master Plan for the development of a designated contiguous unincorporated area within two (2) miles of the corporate limits of the City. During the conduct of the public hearing, the Plan Commission was satisfied that the amendment to the Master Plan, as presented, successfully meets the needs and future requirements of the City of Richmond and the designated two (2) mile fringe area. Therefore, the Richmond City Plan Commission voted six (6) to zero (0) to adopt the amendment to the Master Plan and recommend an Ordinance for its enforcement. Certified copies of Resolution No. 2-1978 adopting the amendment and Ordinance No. 34-1978 recommended for the enforcement of the amendment have been trans- mitted to Common Council for your consideration. The Richmond City Plan Commission shall initiate the necessary proceedings to assume planning and zoning jurisdiction in the two (2) mile fringe area once Common Council adopts the amend- ment to the Master Plan and Ordinance No. 34-1978 for the enforce- ment.
