A RESOLUTION:
AUTHORIZING TIME EXTENSIONS FOR COMPLETION OF PUBLIC
IMPROVEMENTS AND APPROVING PERFORMANCE GUARANTEES
FOR STOWERS PUBLIC IMPROVEMENTS PLAN FOR RT. 621
(EVERGREEN MILL ROAD), WALLACE DRIVE EXTENDED, AND
STOWERS LANE; STOWERS SECTION I; STOWERS PHASE 1, SECTION
2; PHASE 2, SECTION 3; AND THE RECREATION CENTER
WHEREAS, Richmond American Homes, the developer of Stowers Public Improvements Plan
for Rt. 621 (Evergreen Mill Road), Wallace Drive Extended, and Stowers Lane; Stowers Section I;
Stowers Phase I, Section 2; Phase 2, Section 3; and the Recreation Center has not completed all the
required public improvements in accordance with the approved construction drawings and town standards
within the two-year period agreed to in the contract for public improvements and previously approved
time extensions; and
WHEREAS, the developer has requested time extensions to complete the public improvements;
and
WHEREAS, corporate surety bonds from the American Home Assurance Company in the
amount of $103,200.00 for Stowers Public Improvements Plan for Rt. 621 (Evergreen Mill Road),
Wallace Drive Extended, and Stowers Lane; in the amount of $211,508.00 for Stowers Phase 1, Section
2; in the amount of $187,600.00 for Phase 2, Section 3; and in the amount of $169,500.00 for the
Recreation Center were provided by the developer and approved by the Council to guarantee installation
of public improvements; and
WHEREAS, a corporate surety bond from the St. Paul Fire and Marine Insurance Company in the
amount of $337,588.00 was provided by the developer and approved by the Council to guarantee
installation of public improvements for Stowers Section 1; and
WHEREAS, the town's Director of Engineering and Public Works recommends time extensions
to June 30, 2006.

STOWERS LANE; STOWERS SECTION 1; STOWERS PHASE 1, SECTION
2; PHASE 2, SECTION 3; AND THE RECREATION CENTER
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. The corporate surety bonds from the American Home Assurance Company in the
amount of $103,200.00 for Stowers Public Improvements Plan for Rt. 621 (Evergreen Mill Road),
Wallace Drive Extended, and Stowers Lane; in the amount of$211,508.00 for Stowers Phase I, Section
2; in the amount of $187,600.00 for Phase 2, Section 3; and in the amount of $169,500.00 for the
Recreation Center; and from the St. Paul Fire and Marine Insurance Company in the amount of
$337,588.00 for Section 1 are approved to guarantee the installation of public improvements.
SECTION II. Time extensions to June 30, 2006 for completion of the public improvements in
Stowers Public Improvements Plan for Rt. 621 (Evergreen Mill Road), Wallace Drive Extended, and
Stowers Lane; Stowers Section 1; in Stowers Phase I, Section 2; in Stowers Phase 2, Section 3; and the
Recreation Center are approved.
