Fza SPECIAL ORDINANCE NO. 38 - 1978' AN ORDINANCE TO ANNEX TO THE CITY OF RICHMOND, INDIANA, CERTAIN CONTIGUOUS TERRITORY, ADJACENT AND ABUTTING THERETO, DESCRIBING SAME, PROVIDING FOR THE PUBLICATION THEREOF, AND FIXING THE TIME WHEN THE SAME SHALL TAKE EFFECT, WHEREAS, The Chesapeake and Ohio Railway Companr and Arlace D. Moore and Louise Moore; and Alice Longstreth White and Joseph E. Longstreth,each being owners of certain parcels of land, all being within the hereinafter described area, have petitioned the Common Council of the City of Richmond, Indiana for the voluntary annexation of said hereinafter described area, as set out_,and in accordance with IC1971, 18-5-10-23; and, WHEREAS, The area to be annexed is contiguous and adjacent to the present boundary of the City of Richmond, Indiana. WHEREAS, More than fifty-one (51) percent of the property owners of the area requested to be annexed, have signed the petition requesting annexation of the hereinafter described property. NOW THEREFORE. BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF RICHMOND, WAYNE COUNTY, INDI.ANA: Section (1) That the following described territory, adjacent to the corporate boundaries of the City of Richmond, be annexed to and hereby is declared to be a part of the said City of Richmond, Indiana; said territory being located in Wayne Township, Wayne County, State of Indiana, and more particularly described as follows; to -wit: Beginning at the intersection of the west line of the southwest quarter of section twenty (20), Township Fourteen (14), range one (1) west and the present corporation line of the City of Richmond, Indiana; then running northwardly along said section line to the northwest corner of the southwest quarter of section twenty (20), Township fourteen (14), range one (1) west; thence eastwardly along the north line of said quarter section and the north line of the southeast quarter of section twenty (20), Township Fourteen (14), range one (1) west to the intersection with the present corporation line of the City of Richmond, Indiana; thence southwardly and westwardly along said corporation line to the place of beginning, containing an area of one hundred ninety one and six tenths (191.6) acres, more or less. Subject To: Any right of way or easements of record. PETITION FOR ANNEXATION The undersigned Arlace D. Moore and Louise Moore being the sole owners of a certain parcel of real estate, a description of which is set out in Exhibit "A" which is attached hereto and by reference is made a part hereof; and Joseph E. Longstreth and Alice Longstreth White being the sole owners of the real estate set out in Exhibit "B" attached hereto and by reference made a part hereof; do hereby petition the Common Council of the City of Richmond, Indiana for the annexation of certain territory, which includes all of the real estate set out in Exhibit "A" and "B" and which territory is presently situated out side and adjacent to the corporate boundaries of the City of Richmond, Wayne County, Indiana as follows: (1) The territory consists of a total of 191.6 acres, more or less, and is adjacent to the corporate boundaries of the City of Richmond, Indiana. The description of said territory petitioned to be annexed is set out in Exhibit "C" which is attached hereto and by reference is made a part hereof. The description and terms and conditions required to be applicable of said annexation are more fully described in proposed Annexation Ordinance No. 38 - 1978 marked Exhibit "D" which is attached hereto and by reference made a part hereof. (2) The petitioners herein are joined by petitioner Chesapeake and Ohio Railway Company in a separate petition and together they are more than fifty-one (51%) percent of the owners of the land requested to be annexed and they all join and request the passage and adoption of said Annexation Ordinance No. 38 -1978, in accordance with the Statutes of the State of Indiana, particularly IC 1971, 18-5-10-23 et seq. Longstreth, Arlace D. and Louise Moore and the C&0 Railroad. The annexation of this territory will permit the City to extend Industries Road east to Chester Boulevard. The extension of Indus- tries Road and the annexation of this particular area are both in compliance with the Master Plan.
