A RESOLUTION: APPROVING TLSE-2005-0007 LOUDOUN COUNTRY DAY SCHOOL
TO PERMIT A TIME EXTENSION FOR USE OF MODULAR
CLASSROOM BUILDINGS AT 237 FAIRVIEW STREET N.W.
WHEREAS, Loudoun Country Day School has requested special exception approval to
permit five modular classroom buildings at 237 Fairview Street N.W.; and
WHEREAS, the request amends #SE 2001-02 Condition #9 originally permitting the
modular classroom buildings on site for five years; and
WHEREAS, the property is located in the R-1, Single Family Residential Zoning
District; and
WHEREAS, on March 6, 2006, the Planning Commission recommended conditional

approval of this application with the conditions set forth below; and
WHEREAS, on March 28, 2006 the Town Council held a public hearing; and
WHEREAS, staff recommends approval, with the conditions set forth below.
THEREFORE, RESOLVED that the Council of the Town of Leesburg in Virginia hereby
approves Special Exception application TLSE-2005-0007, Loudoun Country Day School, 237
Fairview Street N.W., identified in the Loudoun County Land Records as Parcel Identification
Number 270-30-3560, subject to the following conditions:
1. Use Limitation. The special exception shall be granted to the applicant only,
Loudoun Country Day School, or to any corporation in which the applicant
has a controlling interest, for use as a school only. In the event the applicant,
Loudoun Country Day School, is no longer the user of the property, the
special exception approval shall expire and not transfer to a new user unless
the new user obtains a new special exception approval by the Planning
Commission and Town Council and agrees to comply with all Code

requirements for permanent structures including but not limited to drainage,
site development etc. The modular classroom buildings shall not be vested or
grandfathered.
2. Van Accessible Handicap Space. A van accessible handicap space shall be
demarcated on the special exception plat and on site in accordance with Zoning
Ordinance Section 11.6.2.
3. Pedestrian Crosswalk. Within seven days after the date of approval of this special
exception, Applicant shall establish and maintain a written school policy applicable
during school hours that prohibits parking on Fairview Street and advises children
and parents alike not to cross Fairview Street to get to or from school grounds. A
school employee shall be posted at Fairview Street N.W. at the start and end of each
school day. If such a policy is not established and reasonably enforced, the applicant
shall be required to install a crosswalk and flashing 15 MPH speed limit signs on
Fairview Street N.W. to standards established by the Department of Engineering and
Public Works.

4. Fire Marshall. Loudoun Country Day School shall install fire lane signage along the
access roadway in such a manner that clearly prohibits parking and blocking of this
access'for emergency vehicles.
5. Waivers. Approval ofthe special exception does not express or imply any waiver or
modification of the requirements set forth in the Subdivision and Land Development
Regulations, the Zoning Ordinance, or the Design and Construction Standards
Manual. Final plats, development plans, and construction drawings are subject to the
applicable town regulations.
6. Substantial Conformance. This special exception shall be in substantial conformance
with the special exception plat entitled "Loudoun Country Day School", dated 1-11-
06 and prepared by Paciulli, Simmons & Associates.
