Planning Board Members: Myron Martin -Chairman, Hilda Brody, Jim Culbreth, Barbara Page, Evelyn Poole -Kober and Bob Rose. Others: A.W. Kenion, Daniel R. Pearson, Thomas G. Wilson, Pat and John Dorward, Rick Cannity, Gertrude Ashley, Ruby Riley, John P. Kennedy, Jr.,. Charlie Besch, Alice H. Wilkerson, Susan Frankenberg, J.M. Murfree, David and Paula Carter, Oliver and Kat Clayton, Ruth Page, Nat and Edna Ellis, Cyrus Hogue, Eugene Mayo, James Obie, Bill Price, Frank Frederick, Richard Simpson, Craufurd Goodwin, Frank Coleman. Frank Sheffield called the meeting to order and noted that this was the third public hearing on the ordinance. Comments from the first two hearings were reviewed by the Planning Board, and changes were made in the ordinance for presentation at this hearing. The Mayor turned the meeting over to the Chairman of the Planning Board. Martin noted that the ordinance committee of the Planning Board had worked on the ordinance for three years. Members of the audience were asked to limit their remarks to three to four minutes. Martin asked the Zoning Officer for comments. Maltbie pointed out the changes on the zoning map and the major parts of the proposed ordinance which answered questions and comments from citizens. The ordinance would help to deal with the growth expected to come with the I-40 completion near Hillsborough. Dorward said that the comments and suggestions from the last Public Hearings and from business leaders were reviewed by the Planning Board who had addressed all of the comments. There had been some changes. The sign section had been reviewed by the business leaders. We feel that we have addressed the issues and that the ordinance is ready to go to the Town Board. Besch asked about Section 5.2 and if it meant that Brady could not expand. Dorward said that expansion would be allowed with a Conditional Use Permit. Besch asked about the requirement for loading dock for each 10,000 square feet of floor space. Dorward said that it was a small item which could be changed to allow two loading docks for 25,000 square feet. Edna Ellis asked about the new multi -family section which requires a zoning change and two acres minimum. The rezonings would be up to the Town Board. Dorward noted that the multi -family would be spead out and evenly distributed around town and not all in one zone. Wilson said that Wilmore's overriding concern was that one principal structure was allowed on a lot and that a second principal structure would have to have a conditional use permit. The information requested for the conditional use permit would impose a burden on industries. This reference is to 4.32.1 Hogue asked about the Historic District extension and why his house was of interest. Frankenberg said that the area is of historic interset even though a particular house may not be. Wilson asked about the stream buffer zone in some cases being 50 feet from the bank and where there is a mapped floodplain the zone is 50 feet from the f loodp'lain. They would have four acres not buildable. Brody said that the thing to be remembered is that the Zoning Ordinance is a living document and that there are procedures for changing things as they go along. It can be amended down the road. Simpson said that he was concerned about too much control. Hogue said that he was concerned with the land by the Eno and the 50 foot buffer might make his adjacent lot unbuildable. He would rather see the buffer be 50 feet from the stream bed. Johnson said that flood experts had looked at the floodplain of the Eno River in 1975 and that the area where Hogue and Frederick owned land close to the Eno had been under S to 10 feet of water. The experts from Atlanta had discouraged building in the floodplain. Frederick said that he had the same concerns as Hogue and that the water probably wouldn't get up on the back part of his field more than once every 50 years. The new dams up river are creating lower flows. Even though there was water on the first floors of the tax office, the water was not over the field. Sammy Jones asked if there was any change of zoning in Northern Fairview. There is no zone change recommended. Price asked if there would-be an automatic rezoning to multi -family if requested. Sheffield said it would not be automatic, but decided on an individual basis. Wilson said that there should be more distinction between industrial zones and commercial zones since industries are not open to the public. He thought the off street parking requirements for industrial were a bit severe not in the number of spaces per employee but in the islands of plants in the parking areas and in the contract to maintain the parking lot foliage. He felt that there should be differences in areas visited by the public and areas not visited by the public. Simpson said that more notice should be given to property owners when regulations are put into effect for more citizen input. Stephens asked for a check on 15-6 regarding the inclusion of the term halfway houses under the definition of Group Care Facility, and a check on the differences regarding bona fide farm in 2-1 and 3-2. Wilkerson said that the rezoning of the cemetery at the corner of S. Hillsborough Avenue and W. Margaret Lane from Institutional to R-20 was of concerned because of loopholes which might allow houses to be built over the graves since the headstones had bee:i removed. Sheffield said that all cemeteries should be zoned the same. Johnson said that he didn't think that the Town needed to ask all of the information in 4.32.1; vital information needed regarding hazardous wastes would be needed. Wilson said that if the conditional use permit was needed for the second structure, why wasn't it needed for the first structure. Cannity said that it was good that the ordinance had generated interest. He recommended that it be adopted and that changes be made as needed. The Public Hearing was adjourned.
