HomeMy Public PortalAbout2006_03_28_r058 The Town of 14eesburg, . . . ,,-. irglnla Joint Resolution of Loudoun County in Virginia and the Town of Leesburg in Virginia PRESENTED March 28. 2006 RESOLUTION NO. 2006-58 ADOPTED March 28. 2006 A JOINT RESOLUTION: NOTICE OF INTENTION TO APPROVE AND ADOPT A BOUNDARY LINE ADJUSTMENT AGREEMENT BETWEEN THE COUNTY OF LOUDOUN, VIRGINIA AND THE TOWN OF LEESBURG, VIRGINIA AND AUTHORIZING PUBLICATION OF A NOTICE AND A PUBLIC HEARING WHEREAS, Section 15.2-3106 et seq. of the Code ofVirginia (1950), as amended, authorizes Virginia counties and towns to change the boundary lines existing between them by agreement in accord with specified statutory procedures contained therein; and '- WHEREAS, the Annexation Area Development Policies adopted by the Leesburg Town Council and Loudoun County Board of Supervisors authorize the provision of water and sewer services to property owned by PMW Farms Partnership (known as JR's Festival Lakes) and the Central Loudoun Little League, Inc.; and WHEREAS, the properties are located outside the Leesburg Corporate Limits and are in the Northwest quadrant of the intersection ofRivercreek Parkway and Fort Evans Road; and WHEREAS, the owners of the said properties have requested to be connected to the Town's water and sanitary sewer systems and have applied for incorporation into the Town limits for such purposes; and WHEREAS, the Town Council policy gene rally deerns it appropriate to extend water and ',-- sewer service to private property only ifit is located with in the corporate limits of the Town; and -2- RESOLUTION: INTENT TO ADOPT BLA AND AUTHORIZE A PUBLIC HEARING FOR FESTIV AL LAKES '- WHEREAS, the Board of Supervisors of Loudoun County and the Town Council of Leesburg have determined that it is appropriate to bring the land within the Town limits for the purpose of extending Town utilities to such land; and WHEREAS, the Board of Supervisors ofLoudoun County and the Town Council of the Town of Leesburg concur that the existing boundary line between the County of Loudoun and the Town of Leesburg should be changed in accordance with the terms contained in the Boundary Line Adjustment Agreement set forth in Attachment 1 to this Joint Resolution. THEREFORE, RESOLVED by the Board of Supervisors of Loudoun County, Virginia and the Town Council of the Town of Leesburg in Virginia as follows: SECTION I. The Town and the County hereby declare their intent to approve the Boundary Line Adjustment Agreement and hereby authorize the advertisement of a notice of ',-- intent to approve such agreement and a notice of a public hearing. SECTION II. A notice of intent to approve the Boundary Line Adjustment Agreement and a descriptive summary of the Boundary Line Adjustment Agreement between the Town and County sh all be published once a week for two consecutive weeks in the (Leesburg Time- Mirror or Leesburg Today) and the cost for said publication shall be shared equally by the Town of Leesburg and the County of Loudoun pursuant to Section l5.2-3107 of the Code ofVirginia (1950), as amended. SECTION III. The Attorney for the County of Loudoun and the Town Attorney for the Town of Leesburg are hereby authorized to act on behalf of the County of Loudoun and the Town of Leesburg to prepare, file and execute any Documents, Pleadings and Orders necessary to ensure the entry of a Court order designating and establishing the new boundary line. -3- RESOLUTION : INTENT TO ADOPT BLA AND AUTHORIZE A PUBLIC HEARING FOR FESTIVAL LAKES SECTION IV. A public hearing for the County of Loudoun shall be held on the 11 th day of April 2006 and a public hearing for the Town of Leesburg shall be held on the 11 th day of April 2006 to receive public comment on the proposed Boundary Line Adjustment Agreement.
