HomeMy Public PortalAbout2006_05_09_r080 The Town of Leesburg, Virginia PRESENTED: May 9.2006 RESOLUTION NO. 2006-80 ADOPTED: May 9. 2006 A RESOLUTION: APPROVING TLSE-2006-0002, DALE LUMBER COMPANY, PERMITTING CONTINUED USE OF AN OUTDOOR STORAGE AREA AT 16 CARDINAL PARK DRIVE S.E. WHEREAS, Dale Lumber Company has requested special exception approval to permit the continued use of an outdoor storage area at 16 Cardinal Park Drive S.E.; and WHEREAS, the property is located in the I-I, Industrial/Research Park Zoning District; and WHEREAS, on April 6, 2006, the Planning Commission recommended conditional approval of this application with the conditions set forth below; and WHEREAS, on May 9,2006 the Town Council held a public hearing; and WHEREAS, the request amends #SE 2000-03 Condition #1 originally permitting the outdoor storage use for a seven year timeframe; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE, RESOLVED that the Council ofthe Town of Leesburg in Virginia hereby approves Special Exception application TLSE- 2006-0002, Dale Lumber Company, 16 Cardinal Park Drive S.E., identified in the Loudoun County Land Records as Parcel Identification Number 189-18-6809-000, subject to the following conditions: 1. Substantial Conformance. This special exception shall be in substantial conformance with the special exception plat entitled "SPECIAL EXCEPTION APPLICATION Outdoor Storage Area in the I-I District" dated December 28,2005 and prepared by Patton Harris Rust & Associates, PC incorporating sheets 3 and 4 "SPECIAL EXCEPTION Cardinal Park Center Condominium-Phase IV", dated 02-24-00 and prepared by Huntley, Nyce & Associates, Ltd. -2- A RESOLUTION: APPROVING TLSE-2006-0002, DALE LUMBER COMPANY, PERMITTING CONTINUED USE OF AN OUTDOOR STORAGE AREA AT 16 CARDINAL PARK DRIVE S.E. 2. Inspections. The property shall be inspected by the Town's Zoning Inspector every two (2) years to determine that the materials are being stored properly and safely and that the screening remains adequate to buffer the stored materials. 3. Landscaping. Dale Lumber Company shall maintain landscaping and/or replace dead landscaping imposed under #SE-2000-03 to include ten (10) red maple trees, eleven (11) serviceberry, seven (7) red oak trees and two (2) shrubs at locations shown in Exhibit A and approved under #SE-2000-03. 4. Defined Area. The outdoor storage use shall be limited to the area labeled on the special exception plat as "Proposed outdoor storage lot". 5. Parking. No parking of vehicles shall be permitted on any graveled areas. 6. Sea Containers. The sea containers shall not be stacked. 7. Hazardous Materials. The property shall not be used to store hazardous materials, as defined in the most recent version ofthe American Society of Testing and Materials (ASTM) Standard Practice without first obtaining a permit from the appropriate Loudoun County departments. If such permit is issued, a copy shall be forwarded to the Town of Leesburg, Department of Planning, Zoning & Development, and such hazardous materials shall be restricted to those necessary and usual under any by right uses in the I-I zoning district. 8. Waivers. Approval ofthe special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except as specifically approved by Town Councilor as shown as approved by Town Council on the Special Exception Plat and supporting documents. Final plats, development plans, and construction drawings are subject to the applicable town regulations. PASSED this 2th day of Mav 2006. ~0. C'~ . .
