'-- lrglnla PRESENTED:June 13.2006 RESOLUTION NO. 2006-98 ADOPTED: June 13.2006 A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2005-0006 COMMERCE BANK, BANK WITH DRIVE-THROUGH, LEESBURG PLAZA SHOPPING CENTER, EAST MARKET STREET, N.E., TO PERMIT A THREE-LANE DRIVE-THROUGH WITH A 4,100 SQUARE FOOT BANK WHEREAS, Commerce Bank, N.A.. has requested a Special Exception to permit a bank with drive-through, and WHEREAS, the property is located in the B-2 Established Corridor Commercial Zoning District; and WHEREAS, on May 18, 2006 the Planning Commission recommended denial of the Special Exception; and \- WHEREAS, on June 13, 2006 the Town Council held a public hearing; and WHEREAS, the proposed use fails to comply with the Town Plan, and fails to comply with site lighting requirements, and; WHEREAS, staff recommends denial, and WHEREAS, the Council has concluded that the approval of the application would serve the public interest, promote the general welfare of the community, and is in accordance with sound zoning principles. THEREFORE, RESOLVED by the Council ofthe Town of Leesburg in Virginia as follows: Special Exception application TLSE-2005-0006, Commerce Bank, Bank with Drive- Through, Leesburg Plaza Shopping Center, East Market Street, N.E., identified in the Loudoun "---- -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2005-0006 COMMERCE BANK, BANK WITH DRIVE-THROUGH, LEESBURG PLAZA '- SHOPPING CENTER, EAST MARKET STREET, N.E., TO PERMIT A THREE-LANE DRIVE-THROUGH WITH A 4,100 SQUARE FOOT BANK. County Land Records as Parcel Identification Numbers 188-16-3572 is hereby approved with the following conditions: Substantial Conformance: 1. Development of this special exception use shall be in substantial conformance with the Special Exception Plat titled Commerce Bank Special Exception Plan dated 03/28/06, revised 4/20/06, prepared by Bohler Engineering, P.Co. This plat includes Sheets 2 (Site Plan); Sheet 2A (Site Distance Exhibit); Sheet 3 (Overall Site Plan); Sheet 4 (Landscape Plan); Sheet 5 (Lighting Plan): Sheet 6 (Details and Specifications); and Sheet 7 (Architectural Elevations). No Expressed or Implied Waivers: 2. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except as specifically approved by Town Council or as shown as approved by Town Council on the Special Exception Plat and supporting documents. '-.. Site Lighting: 3. All lighting fixtures used to illuminate outdoor areas shall be designed and directed on-site to avoid glare in surrounding areas in accordance with Design and Construction Standards Manual Section 7-670 and Zoning Ordinance Section 12.11. Driveway Relocation: 4. Prior to receipt of Certificate of Occupancy, the applicant shall relocate the southern driveway onto Plaza Street as depicted on the Special Exception Plat titled Commerce Bank Special Exception Plan dated 03/28/06, revised 4/20/06, prepared by Bohler Engineering, P.Co. Driveway Restriction: 5. A sign shall be posted at the relocated driveway exit restricting that exit to right turns out only onto Plaza Street. Landscaping: 6. For the purpose of providing adequate clear sight into and out of the site from Plaza Street and East Market Street, no shrubbery shall be installed in any landscape area that will exceed 36 inches in height at maturity. Turn Lane: 7. Prior to receipt of Occupancy Permit, the applicant shall construct the southbound right-turn lane on Plaza Street as depicted on the Special Exception Plat titled Commerce Bank Special Exception Plan dated 03/28/06, prepared by Bohler Engineering, P.C.. Traffic Modifications: 8. Any required modifications, as a result ofthe proposed right turn lane, to the existing traffic signal, street lights or existing utilities at the intersection of Plaza Street and East Market Street shall be designed to all current standards and constructed by the applicant at no cost to the Town of Leesburg. Parking: 9. Construction of the bank with drive-through shall not result in the loss of parking spaces so that the overall total number of shopping center parking spaces is less than the minimum overall total of spaces required by the Zoning Ordinance. .........
