A RESOLUTION: OVERTURNING THE APRIL 17, 2006 DECISION OF THE BOARD
OF ARCHITECTURAL REVIEW IN CASE TLHP-2005-0144 FOR
INSTALLATION OF A NEW WALL SIGN FOR THE BEST
WESTERN HOTEL AT 726 EAST MARKET STREET.
WHEREAS, Gateway Partnerships (APPELLANT) applied to the Board of Architectural
Review (BOARD) on November 28, 2005, for consideration of building modifications and
installation of a new wall sign; and
WHEREAS, the BOARD discussed the APPELLANT's application at meetings on
December 19,2005, February 22,2006, March 6,2006, and March 20,2006; and
WHEREAS, at the Regular Meeting on March 20, 2006, the BOARD approved the
proposed modifications to the building and deferred action on the requested sign to the April 17,
2006 Regular Meeting; and
WHEREAS, at the Regular Meeting on April 17, 2006, the BOARD denied the
APPELLANT's request for the new wall sign because the proposed design for the sign does not
comply with the H-2 Corridor Design Guidelines because it exceeds the permitted four-color
color scheme requirement that has been established by precedent; and
WHEREAS, the APPELLANT filed the appeal with the Clerk of Council on May 15,
2006, within the thirty-day period required by Section 3.11.15.B Appeals to the Town Council
in the Leesburg Zoning Ordinance; and
WHEREAS, the Town Council heard the appeal on June 27, 2006; and
WHEREAS, the Town Council finds, on appeal, that the decision of the BOARD,
rendered on April 17, 2006, is either contrary to the law or arbitrary and capricious; and

WHEREAS, the Town Council elects to overturn the decision ofthe BOARD, rendered
on April 17, 2006, denying the applicant's request for a new wall sign.
THEREFORE, RESOLVED that the Council of the Town of Leesburg in Virginia hereby
overturns the April 17, 2006 decision ofthe Board of Architectural Review in case TLHP-2005-
0144 for installation of a new wall sign for the Best Western Hotel at 726 East Market Street.
FURTHER RESOLVED that the Council of the Town of Leesburg in Virginia hereby
grants permission to the APPELLANT to install the wall sign requested in case TLHP-2005-
0144.
