A RESOLUTION AUTHORIZING THE ENTERING INTO OF A
REVISED SUBDIVIDEWS AGREEMENT, WITH WOODFIELD
RIDGE, L.L.C.
WHEREAS, the City Council approved a Preliminary Plat of Woodfield
Ridge Part One=and authorized the entering into of a Subdivider's Agreement
upon certain alterations as :stated in the minutes of the meeting held on
April 12; 2006; .r.
WHEREAS, the Subdivider's Agreement has since been altered as
outlined in the minutes; however, DEVELOPER desires further revisions of
the Subdivider's Agreement;
WHEREAS, the approval of the Preliminary Plat of Woodfield Ridge
Part One continues to stand as it wa's approved on April 12, 2006; but the
Subdivider's Agreement as `approved,on April' 12, 2006, is now'void and is
replaced with the "Subdivider's Agreement — Revised", a copy of which is
attached hereto and incorporated herein;
WHEREAS, City Attorney, Stephen N. 'Greenleaf, has given his
approval of the Subdivider's Agreement — Revised; and
WHEREAS, City Engineer, Michael W. Hart, has given his approval of
the Subdivider's Agreement Revised; provided however, that no
improvements shall be constructed,or installed without his written approval,
which may be withheld until such time as all necessary permits have been
issued from the state and federal agencies; and
FURTHER, the City desires to formally signify its approval of and
authorize the entering into of the Subdivider's Agreemend — Revised .a for
Woodfield Ridge Part One.
NOW, THEREFORE, BE IT RESOLVED, by the City Council Tiffin,
Iowa, that the Subdivider's Agreement — Revised for Woodfield Ridge Part
One is hereby approved and the previously approved version of the same as
approved on April 12, 2006, is void. The (Mayor and City Clerk are hereby
authorized and directed to execute the Agreement and upon the signing of the
Agreement by the DEVELOPER, the City shall properly record this
