HomeMy Public PortalAboutMisc docs MEMORANDUM TO: Tom Benton, Director Planning & Code Enforcement Department FROM: Allen Garner, City Counselor DATE: July 26, 1991 RE: Nuisance Tax Billing Recently I was contacted by Tom Vetter concerning a problem with our tax billing of a lot which belonged to the John Rollins estate located at 1019 East Dunklin Street. The immediate problem Mr. Vetter raised has been somewhat mooted by his failure to find a purchaser for the lot and an indication the property will be sold for taxes at the Courthouse in the near future. However, in the process of reviewing the matter after Mr. Vetter had contacted me, I note several issues which need attention or clarification. The tax bill sent up to the City Clerk on July 10, 1991, includes charges for work done in June, July, and August of 1989 as well as June of 1991. A $55.00 charge occurs every time the weeds were cut for "administrative costs" which is generically listed as long distance telephone calls, mailings, posting, and search of ownership, which seems somewhat redundant for one tax bill. It would appear the City paid $135.00 to clear the weeds, but requested $355.00 for payment. While the original plan was to come up with a standardized administrative cost, common sense would dictate that we be somewhat reasonable in the number of times we attempt to collect an undocumented cost on the same piece of property during a short period of time. It has been reported that on other cases and instances we have waived all the administrative costs and sought just to collect the cleanup costs. We must remain consistent in how we treat individuals who are the recipients of our notices, particularly when we get to the tax billing stage. It is somewhat confusing as to what happened in the year 1990 and why, if we had outstanding bills from 1989, these were not tax billed two years ago or at the latest last year. The purpose of the process is not to rush to the Courthouse right before the property is to be sold, but to utilize the lien to enforce our right to collect the cleanup costs at the earliest possible date. From a paper processing standpoint it would be much simpler if we could process these on a routine basis at the same time of each year or twice a year rather than have items rushed through the process without adequate time to review the notices and the process in order to get our name on a piece of property that is about to be sold. One final note Mr. Vetter raised is a concern that should be relayed to the appropriate people. The notice posted on the property regarding the violation does not indicate that Mr. Vetter was acting other than for himself. He did not appreciate having his name on a notice when the property belongs to an estate for which he is • Memorandum July 26, 1991 Page Two serving as the attorney. Considering we had charged four times to determine the title to the property, it would appear we should have known who the title holder was for purposes of our notice. I would appreciate it if you would review these items with your staff and respond to me with any suggestions you have as to how we might best address the issues raised herein. I am negotiating a sale of the property for less than $1,000. After paying delinquent real estate taxes, publication costs, probate fees (but nothing for the attorney for the estate) there's not enough to pay the amount of the City's lien.
