A RESOLUTION: AUTHORIZING A TIME EXTENSION FOR COMPLETION OF
PUBLIC IMPROVEMENTS AND APPROVING A PERFORMANCE
GUARANTEE FOR LANSDOWNE ON THE POTOMAC SECTIONS
42 & 43
WHEREAS, West Goose Creek, LLC, the developer of Lansdowne on the Potomac
Sections 42 & 43 has not completed all the required public improvements in accordance with the
approved construction drawings and Town standards within the two-year period agreed to in the
contract for public improvements; and
WHEREAS, this development is located in Loudoun County and the Town's bonded
improvements are water and sanitary sewer only; and
WHEREAS, the developer has requested a time extension to complete the public
improvements; and
WHEREAS, a corporate surety bond from the ARCH Insurance Company in the amount
of $44,107 was provided by the developer to guarantee the installation of public improvements;
and
WHEREAS, the Town's Director of Engineering and Public Works recommends a time
extension to May 30,2007.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The corporate surety bond from the ARCH Insurance Company in the
amount of $44,107 is approved to guarantee the installation of public improvements in
Lansdowne on the Potomac Section 42 & 43.
