Item 2: Approval of minutes from December 5, 1985 Item 3: Rezoning request from Powers, Inc. - Harder Venture for 22.61 acres located at the southwest quadrant of the intersection of SR 1009 and I-85 (directly behind McDonald's). Tax map reference is 42, Block B, lot 3. The request is for rezoning the lot from R-10 to General Commercial. Item 4: Rezoning request from Lane Management and Development Co. for property located west of and adjacent to Allison Rd (SR 1148), south of Dimmocks Mill Rd (Tax map reference 38, Block B, lot 10B). The request is to rezone approximately 78.3 acres from Agricultural -Residential to Office -Institutional. Item 5: J.W. Taylor has requested thatt the Planning Board change the zoning designation on the proposed zoning map for property located north of the intersection of Hwy 57 and Hwy 86. Referenced lot is identified as Lot 10, Block B on Tax Map 5. The property is currently zoned R-10; applicant is requesting that it be rezoned to Neighborhood -Business. The property has been used for business for over 25 years (service station, store, game room, and now as a beauty shop). Item 6: Overview of proposed zoning map changes in preparation for public hearing to be held on January 28. Item 7: Report on .Pantry Area study, which includes the proposed Scotswood development. Item 8: Develop a three month work schedule (priority list) for the planning board and planning department. Item 9: Schedule a joint planning session with the Orange County planning board. MINUTES OF THE JANUARY 2, 1986 PLANNING BOARD MEETING Members present: Barbara Page, Nancy Goodwin, Calvin Ashley, Tarleton Davis, Bob Rose, Dr. Robert Murphy and Hilda Brody. Others: Patricia Krebs, Rev. Chester Andrews, Representative from the Historical Society, Roman Kolodij, J. W. Taylor and Laura Hill, Zoning Officer. Item 1- Appointment of Vice -Chairman Murphy made a motion to appoint Bob Rose, Page seconded it. The motion passed unanimously. Rose then called the meeting to order. Item 2- Approval of minutes from the December 5, 1985 meeting. Barbara Page should be added to the list of members present. Page made a motion for approval of the minutes, Ashley seconded it. The motion was carried. The Zoning Officer was asked to send a card to Evelyn Poole -Kober in expression of sympathy during the loss of her father. The Planning Board members welcomed Rev. Chester Andrews as the Representative from the Historical Society who will be attending the meetings. Item 3- Rezoning request from Powers, Inc. - Harder Venture for 22.61 acres located at the southwest quadrant of intersection of SR 1009 and I-85 (directly behind McDonald's). Tax Map reference is 42, Block B, Lot 3. The request is for rezoning the lot from R-10 to General C6mmercial. The Zoning Officer presented a map showing the topography of the land, and the location of Murdock Rd. (Lakeside Dr.) which intersects at SR 1009. The Zoning Officer explained that Murdock Rd. may be used as access to this project and that it possibly would be upgraded to state standards. The road design will be sent to Dwight Kelly, engineer with DOT, for his comments. The board members expressed their concerns as to whether or not the road will be upgraded to state standards and who would have ownership of the road. The Zoning Officer said that the road was to have been upgraded as part of the conditional use permit that was issued for Coachwood and Gateway Village. She said the issue of the upgrading of the road would be addressed at the January 28th public hearing. The Zoning Officer said the two options which are being considered for access to the area are (1) to use the existing road for access and bear off to the south or (2) to use the corner next to the McDonald's property. Roman Kolodij, architect, said that in order to meet all the concerns of DOT, the Town, and the adjacent property owners regarding the flow of traffic in the area, the entrance would have to be designated as a public road. He reported that there has been some discussion to extend the road west to connect onto Orange Grove Road. If the road is extended to Orange Grove Road, then DOT would take up maintenance of the road. The general feeling by DOT is that Lakeside Dr. is a desirable place for the entrance to the 22 acre site. Lakeside is now a private road and has not been designated by DOT as a public road. The motion was passed unanimously. The Zoning Officer informed the board members that the matter concerning the road has been referred to the Town Attorney. Item 4- Rezoning request from Lane Management and Development Co. for property located west of and including Allison Rd (SR 1148), south of Dimmocks Mill Rd (Tax Map reference 38, Block B, Lot 10B). The request is to rezone approximately 78.3 acres from Agricultural -Residential to Office -Institutional. The Zoning Officer presented a map showing the realignment of SR 1148. The present zoning to the east and north is Industrial; to the southeast, west and south the zoning is Agricultural -Residential. 28.8 acres will be donated to the Town and possibly an additional 20 acres may be donated. The entire area is to be zoned Office -Institutional except for the 28.8 acres. The members were concerned about the route that would be used for trucks to get to and from the area. They expressed concerns about the road being built over the mountain, and did not feel there should be any more traffic through Town. There was a suggestion that the road be built from the Efland exit. Item 5- J. W. Taylor has requested that the Planning Board change the zoning designation on the proposed zoning map for property located north of the inter- section of Hwy. 57 and Hwy. 86. Referenced lot is identified as Lot 10. Block B on Tax Map 5. The property is currently zoned R-10; applicant is requesting that it be rezoned to Neighborhood -Business. The property has been used for business for over 25 years (service station, store, game room, and now as a beauty shop). The Zoning Officer said the property is 1.8 acres and is now being use as a beauty shop. Hill was informed by the former zoning officer that the business was shut down for awhile. There is public water available to the site and a private septic tank. The Water/ Sewer Superintendent indicated that there are no plans to extend sewer to this site at this time. According to the new zoning ordinance, Neighborhood -Business districts should be located at sub - collector and local streets. The Zoning Officer said a major concern was if sewer would be extended to the area. Taylor said he thought it would, but that he did not know when. Rose ,sked if it had to have water and _sewer to be rezoned. The. -Zoning -Officer said it was not stated that way in the new ordinance. The application criteria under the Neighborhood Business district section of the new zoning ordinance Planning Board Meeting January 2, 1986 Page 3 states that "the district (NB) will usually be applied where the following conditions exist: Water and sewer does exist at the site or are to be installed as part of the development process". The Zoning Officer mentioned other issues that needed to be looked at: 1) If the property was to be zoned to Neighborhood -Business would there be enough parking space, and 2) Who will the business serve? Would it only serve the neighborhood area, or would it also serve travelers along Hwy. 86 and Hwy. 57? Taylor said he felt that General Commercial would be better than Neighborhood - Business and would also help to get sewer service extended to the area. Ashley made a motion that the property be rezoned to Neighborhood -Business, Brody seconded it. Brody then withdrew her second and Page seconded it. The motion was carried with 4 voting in favor of the rezoning to Neighborhood -Business and 3 opposed. Item 6- Overview of proposed zoning map changes in preparation for public hearing to be held on January 28. The Zoning Officer asked the board for confirmation for the proposed zoning map changes listed below: Harder property to remain as Multi -family. Cemetery located on Margaret Lane which is now zoned Office -Institutional to be rezoned R-20. Property located next to R & J Speciality Co. is now zoned General Commercial is proposed to be zoned R-20. Odie Street proposed rezoning is R-20. The Zoning Officer reported that the majority of the lots were to small for a R-20 zoning and would be non -conforming. Ashley made a motion that Odie Street be rezoned to R-15, Page seconded it. The motion was carried. George Mayo property should be rezoned A -R. Item 7- Report on Pantry Area Study, which includes the proposed Scotswood Development The Zoning Officer presented a map which illustrated the existing and proposed property lines, the topography of the land at 10' intervals and the outlined Scotswood area showing the drainage flow. A slope analysis will be completed later. A map was also presented which showed all soil types, septic tank suitability, and soil stability, according to the Orange County Soil Survey. The third map was an overlay of the current zoning districts with all major roads outlines. The map also illustrated the current average daily traffic count and the additional ADT count if Scotswood was approved. The existing average daily count is now 2100; the Scotswood development would increase the total count to 4860 (This includes the existing 2100). The average daily count going out Hwy. 70 towards Town is now 7900. The Scotswood project would increase this to 10,200. On St. Mary's Road the average daily count is now 3100. This would increase to 6550. The Zoning Officer's data was from the traffic impact analysis submitted with the Scotswood proposal. Item 8- Develop a three month work schedule (priority list) for the planning board and planning department. The Zoning Officer asked the board for suggestions on drafting a work schedule and priority list. The Zoning Officer said her list included: mapping existing Planning Board Meeting January 2, 1985 Page 4 land uses, developing a greenways program, revising application forms and drafting forms which explained application procedures for different types of zoning request (i.e. rezoning, variances, site plan approval, etc.) Also included on her list was a computer which will be added to the Town Board's January agenda. She asked the board when they would like agenda packets to be ready. The members agreed they would like them ready by 12:00 on the Friday prior to the scheduled meeting and members can pick these up. Item 9- Schedule a joint planning session with th Orange County Planning Board. The Zoning Officer reported that the County would like to meet with the Town's Planning Board within 5 or 6 week. The Board set a date for February 13, 1986, at 7:30 P:M. in the Town barn. Item 10- Report on Zoning Violations Wesley Woods - the alleyway has been cleaned up. Hillsborough Barbell Club - applicant came in and said they were taking down their old sign and will put up their new one. Mobile home corner of Nash and King St. has been skirted but the tongue has not been removed. If the tongue is not removed, then the tongue should be skirted. Mobile home behind West End Billards - there is now a second mobile home there. The Zoning Officer has sent a letter to the owner informing him they are for residential use and not for storage. Temporary business in the A & P parking lot. The owner will need a zoning permit, a building permit and a privilege license. He may also need a health permit. The Zoning officer was informed by the owner that his business will be moved Sunday. The Zoning Officer was asked to bring the matter of temporary businesses to the attention of the Town Board at their January meeting. Crawford Mobile Home Park - the Zoning Officer talked with the Town Attorney who asked what the new ordinance will state. The new ordinance does not mention existing mobile home parks. The Zoning Officer was told that if it is out of compliance in the old ordinance then it would be the same in the new ordinance. A letter has been wirtten to the owners. Lakeside Drive - The Zoning Officer has been checking into the matter as to whether the Conditional Use Permit can be revoked. This item is on the agenda for the Board of Adjustment4 The Zoning Officer reported that she was meeting with the Town Attorney next week to discuss zoning violations.
