HomeMy Public PortalAbout047-1978 - Amending Ordinance known as The Sub-Division OrdinanceGENERAL ORDINANCE NO. 47-1978 AN ORDINANCE AMENDING ORDINANCE NO. 1800-1960 COMMONLY KNOWN AS THE SUB- DIVISION ORDINANCE OF THE CITY OF RICHMOND, INDIANA. WHEREAS, Article III, Section VI, Paragraph a, currently reads as follows: SECTION VI. STREET CONSTRUCTION. a. All streets shall be graded and paved roadway, con- crete curb, gutter and sidewalks installed in accord- ance with plans showing grades, profiles and sections of streets, which shall be submitted to the Board of Public Works and Safety for approval. The installation of sidewalks on any street or part of street shall be required where the average number of lots is more than three (3) lots per gross acre. WHEREAS, it is the intent of this Ordinance to amend Article III, Section VI, Paragraph a, to provide for the installation of street light conduit and splice boxes. The cost of said installation to be borne by Rich- mond Power and Light, at the time street improvements are originally installed to permit more economical installation of street lights when the development has grown enough to warrant them; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the - day of _ 1978, at which time remonstrances were heard from aTl parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was -7 to in favor of/in opposition to recommending the passage of Ordinance No. 47-1978. BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. Article III Section Vi Paragraph a, of Ordinance No. 1800-1960 shall read amended as follows: SECTION VI. STREET CONSTRUCTION. a. The developer shall coordinate the construction of new streets with Richmond Power and Light Company to enable Richmond Power and Light Company to install, at their own expense, street light conduit and splice boxes to permit the more economical installation of street lights when the development has grown enough to warrant them. To facilitate this installation the developer shall give full consideration and cooperation to Richmond Power and Light Company. All streets shall be ,graded and paved roadway, concrete curb, gutter and sidewalks installed in accordance with plans showing grades, profiles and sections of streets, which shall be submitted to the Board of Public Works and Safety for approval. The installation of sidewalks on any street or part of street shall be required where the average number of lots is more than three (3) lots per gross acre. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. The amendment requires developers to coordinate the construction of new streets with the Richmond Power & Light Company so to enable Richmond Power and Light Company to install street light conduit and splice boxes during new street construction.
