ALSO PRESENT: PLANNING AND ZONING ADMINISTRATOR LOREN KOHNEN AND PLANNING AND ZONING ASSISTANT SANDIE LARSON. DECKER VELIE ARRIVED AT 7:52 P.M. ABSENT: SUSIE MACKAY, FRANK MIGNONE AND BOB BRADLEY Chairperson Penny Elsenpeter called the meeting to order at 7:41 p.m. 1. MINUTES OF MAY 14, 1996 MOVED BY ANNE HEIDEMAN AND SECONDED BY CAROLYN SMITH TO APPROVE THE MINUTES AS PRESENTED. MOTION PASSED. 2. DAVID AND SUSAN SWEEN - 212 HOLY NAME DRIVE - FRONT YARD SET BACK VARIANCE - 7:42 P.M. Loren Kohnen read his memo to the planning commission and put up overheads of the site and the plans for the porch. Anne Heideman said that the plan blends in well with the age of the house. MOVED BY ANNE HEIDEMAN AND SECONDED BY BRUCE WORKMAN TO RECOMMEND APPROVAL OF A FRONT YARD SETBACK VARIANCE OF 24' TO REPLACE AN EXISTING PORCH WITH THE FOLLOWING HARDSHIPS: 1. Shape of the lot. 2. Location of house 3. Consistent with neighboring homes. MOTION PASSED. 3. FRANK AND SALLY PERNAT - 2937 LAKESHORE AVE - LAKE SET BACK VARIANCE - 7:45 P.M. Penny Elsenpeter stated that the applicants could not be here this evening, but requested that the planning commission go ahead if they chose to do so. Loren Kohnen read his memo and put up an overhead of the site. Anne Heideman said that she had a problem with the existing shed on the property that according to the survey is over the property line. 1 Bruce Workman said that is not the issue that was brought here and we really should not worry about it. A. Heideman said that it had to be looked at and if the building was properly constructed it could be moved. L. Kohnen said according to the size of the shed it could be 5' from the line. P. Elsenpeter said there have been others at the Beach that have had to move them and others that we have just acknowledged that they are there. L. Kohnen said that it could be put in the conditions that if it comes in disrepair then it would have to be done correctly when it was fixed. B. Workman said he would be happy with than. A. Heideman thought we should be more precise. P. Elsenpeter said if something happens to it, then it must meet the set -back requirements. Carolyn Smith said that is fine unless we are treating them differently than others. MOVED BY BRUCE WORKMAN AND SECONDED BY CHRIS CROSBY TO RECOMMEND APPROVAL OF A LAKE SET -BACK VARIANCE OF 34' TO REPLACE AN EXISTING DECK WITH THE FOLLOWING HARDSHIPS AND CONDITION: 1. Size and configuration of lot 2. Location of existing deck 3. If existing shed falls into disrepair or is 50% or more destroyed, it then must meet setbacks when it is reconstructed. MOTION PASSED. 4. COLLEEN AND JOHN MORIN - 4632 BROOK STREET - REAR YARD SET BACK VARIANCE - 7:52 P.M. Loren Kohnen read his memo to the planning commission and put up on overhead of the site. He stated that this would be a 2 level deck replacing what was there now. Bruce Workman wanted to know if the new deck would be smaller than the existing. John Morin said the upper deck would be smaller. B. Workman confirmed that the new design would be less intrusive. L. Kohnen said yes and pointed out on the overhead the new design. 2 MOVED BY CAROLYN SMITH AND SECONDED BY CHRIS CROSBY TO RECOMMEND APPROVAL OF THE 21.5' REAR SET -BACK VARIANCE WITH THE FOLLOWING HARDSHIPS: 1. Location of existing deck 2. Location of house 3. Size and shape of lot 4. Streets on two sides of the house MOTION PASSED. 5. LUNDGREN BROTHERS/WALLACE DOERR - 4405 COUNTY ROAD 116 - RE-ZONING/COMBINATION AND RE -PLAT - PUBLIC HEARING - 7:59 P.M. Loren Kohnen read his memo to the planning commission and put up an overhead of the proposed re -plat. He mentioned the three driveways that would come off the same cul-de-sac and that one of them would have to come off the throat of the cul-de-sac. He said that this was a nice improvement of the area. Penny Elsenpeter said that the first item is the re -zoning. MOVED BY ANNE HEIDEMAN AND SECONDED BY CAROLYN SMITH TO RECOMMEND APPROVAL OF RE -ZONING OF 4405 COUNTY ROAD 116 FROM RURAL RESIDENTIAL TO SUBURBAN RESIDENTIAL/PUD AS PART OF THE FOXBERRY FARM DEVELOPMENT. MOTION PASSED. MOVED BY CAROLYN SMITH AND SECONDED BY BRUCE WORKMAN TO RECOMMEND APPROVAL OF THE COMBINATION AND THEN RE -PLAT OF THE WALLACE DOERR PARCEL AND TWO FOXBERRY FARMS LOTS TO FOXBERRY FARMS THIRD ADDITION WITH THE FOLLOWING CONDITIONS: 1. Driveways to be approved by public works director 2. Existing driveway on County Road 116 to be removed no later than 24 months after final plat approval of Foxberry Farms 3rd Addition or 30 days after home is vacated or removed. 3 Recommendations of city engineer's letter of May 28, 1996. MOTION PASSED. 6. JEFF & BRENDA FISCHER/JB OIL - 822 HIGHWAY #55 - AMOCO/McDONALD'S/CAR WASH - CONTINUED FROM MAY - 8:07 P.M. MOVED BY ANNE HEIDEMAN AND SECONDED BY BRUCE WORKMAN TO TABLE THIS APPLICATION TO THE JULY MEETING. MOTION PASSED. 3 7. DISCUSSION - LOCATIONS FOR AFFORDABLE/SENIOR HOUSING - 8:11 P.M. Loren Kohnen told the planning commission of the developer that had been in concerning a condominium development on the Wally Cates property. Carolyn Smith thought that would be a good place for multiple housing. L. Kohnen said that St. Anne's property in Hamel would be a good location. He said that he had talked with Jerry Dykhoff who said that a number of the older parishioners from St. Anne's would like to be able to stay in the area. He also said that the Cate's property is not really good for re -zoning because there is not that much commercial land available. C. Smith asked about the two MR area's north of Highway #55. Bruce Workman asked if we were under the gun to get this done. Anne Heideman said that the St. Anne's property had been before the planning commission in the past with two earlier comprehensive plan discussions and at that time there was indications from the then pastor that they would be interested in something for their property. Penny Elsenpeter asked if there were any other location suggestions. L. Kohnen said that the re -zoning of the Cate's property could be discussed if an application comes in. B. Workman wondered about up by Loretto. That location has services available. said it would be hard to get sewer to that area._ C. Smith A. Heideman said she is very much opposed to re -zoning north of Highway #55 in the commercial area until such time as a firm proposal was before us. B. Workman said more sewer units could not be asked for when the city is not using what we already have. There was more discussion of the Cates and Ballroom properties. C. Smith said that if there is talk of closing off some of the Highway #55 entrances, maybe now is the time to acquire ROW for putting through a road for that area. Wally Doerr, 4405 County Road 116, asked about the property that he owned south of Foxberry Farms. He said it is within walking distance to Mayer Mobile, etc. and that there are 26 buildable acres out of the 53+ acres, so there would be open, park and wetland areas. 4 C. Smith said it sounded like an interesting idea and she liked the idea of having a nature/green area with the multiple family zoning. A. Heideman said it is less of a problem rezoning from rural residential to multiple residential that from commercial. B. Workman said it would be a good use of the land, staging it from single family to multiple family to commercial. W. Doerr mentioned the five homes that were in the area that more than likely would have to be removed if the area was commercial. The planning commission told Mr. Doerr that they would like to see a proposal. THE PLANNING COMMISSION RECOMMENDATION TO THE CITY COUNCIL FOR AREAS THAT WOULD BE SUITED FOR MULTIPLE FAMILY ZONING FOR AFFORDABLE/SENIOR HOUSING: 1. The best area would be the Highway 12/County Road 29 area that recently had a proposal for affordable housing. 2. Wally Doerr property south of Foxberry Farms and north of TC America (a proposal comes in). 3. St. Anne's property. MOVED BY ANNE HEIDEMAN AND SECONDED BY CAROLYN SMITH TO ADJOURN. MOTION PASSED.
