HomeMy Public PortalAbout2006_10_05_r169 The Town of Leesburg, Virginia PRESENTED: October 5, 2006 RESOLUTION NO. 2006-169 ADOPTED: October 5,2006 A RESOLUTION: APPROVING TLSE-2006-0007, CROSSROADS BAPTIST CHURCH, PERMITTING A CHILD CARE CENTER USE FOR A MAXIMUM OF 40 CHILDREN AT 850 EDWARDS FERRY ROAD N.E. WHEREAS, Crossroads Baptist Church has requested special exception approval to permit a child care center for 40 children at 850 Edwards Ferry Road N.E.; and WHEREAS, the property is located in the R-4, Residential Single Family Zoning District; and WHEREAS, on September 12,2006, the Town Council authorized a joint public hearing of this application with the Planning Commission; and WHEREAS, on October 5, 2006 the Town Council held a joint public hearing with the Planning Commission; and WHEREAS, the child care center will benefit the public by providing education, offering intellectual stimulus and fostering emotional and social development for three and four year old children from Leesburg and the surrounding area; and WHEREAS, the Planning Commission recommends approval, with the conditions set forth below. THEREFORE, RESOLVED that the Council of the Town of Leesburg in Virginia hereby approves Special Exception TLSE- 2006-0007, Crossroads Baptist Church, 850 Edwards Ferry Road N.E., identified in the Loudoun County Land Records as Parcel Identification Number 188- 38-1840-000, subject to the following conditions: 1. Substantial Conformance. This special exception shall be in substantial conformance with the special exception plat entitled "Special Exception Package", dated June 5, 2006 and prepared by REP Architects, Inc. -2- A RESOLUTION: APPROVING TLSE-2006-0007, CROSSROADS BAPTIST CHURCH, PERMITTING A CHILD CARE CENTER USE FOR A MAXIMUM OF 40 CHILDREN AT 850 EDWARDS FERRY ROAD N.E. 2. Waivers. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual. Final plats, development plans, and construction drawings are subject to the applicable town regulations. 3. Hours of Operation. The child care center shall operate between the hours of9:30 AM to 1 :30 PM Monday through Thursday and will facilitate a maximum of 40 students. 4. Ingress and Egress. The Edwards Ferry Road and Appletree Drive access points to the site shall remain open for use during the hours of operation ofthe child care center facility. 5. One-Way Vehicular Circulation. One-way vehicular circulation shall be provided on the site during the hours of operation of the child care center by the placement of signs in the parking lot indicating a one-way traffic flow as depicted on the "Supplement to Special Exception Applicant's Response to 1 st Referral of Crossroads Baptist Church Child Care Center Comments" dated September 28, 2006, page 1. (Attached hereto and incorporated herein as Attachment 12). 6. Arrival and Departure Zone. A designated arrival and departure zone for child drop off and pick up shall be provided on site through an area described by signage as a "No Parking UnloadingILoading Zone". The area shall be located along the sidewalk south of the west entrance to the building and continuing the full length of the front sidewalk. 7. Landscaping. Three (3) large canopy street trees shall be re-installed along Edwards Ferry Road in accordance with TLPF-1987-0037 within 12 months of approval ofTLSE-2006-0007 by Town Council. 8. Fence. A fence at least four (4) feet in height shall completely enclose the outdoor recreation area prior to issuance of a zoning permit for the child care center use. PASSED this llh day of October 2006.
