The Board had questions with regards to zone 2 lots and existing systems. NI will set up a meeting with Attorney Veara and a few Board members to discuss this issue and come up with different wording. 2. Cape Cod Engineering-continued variance application for Bates Lane Bob Perry, Engineer and Lisa Labrecque, owner of property were present. This request is for the following variances that were previously approved and have expired: 1. 8 foot variance from property line setback for SAS 2. 8 foot variance from property line setback for reserve SAS 3. 20 foot variance from required separation between SAS and vegetated wetland 4. 22 foot variance between septic and the bordering vegetated wetland 5. 16 foot variance from required separation between bvw and SAS reserve 6. Variance from Section III 3.3 -granting a variance for new construction in ESA BP explained that the Conservation Commission had approved a smaller house for this lot and that the septic tank and pump chamber were moved slightly on the plan. He stated that this project would now have less impact on this lot. The system will have pressure distribution. An abutter's letter was handed out to the Board and entered into the record of the meeting. JH voiced her concerns over issuing a variance on this lot. Motion: AP-approve variances as requested. JR seconded. 3 yes. JH-no 3. Request to keep septic system less than 300' from pond for 14 Captain Fitts Road Jason Ellis represented the owner. This is an existing home that just had an inspection which passed except for the SAS being to close to the pond. Motion: JR-grant variance. AP seconded. 4 yes. 4. Oil tank variance request for 121 Whiffletree Avenue Motion: JR-grant variance. AP seconded. 4 yes 5. Oil tank variance request for 77 Turning Mill Road Motion: JR-grant variance. AP seconded. 4 yes. The owner is putting a sunroom on his house and that would make the room count larger. His septic permit states 330 gallons per day. The plan stated 549 gallons per day. The system was installed in 2004, which makes it a current code Title V. Motion: AP-accept the 549 gpd flow from the plan and allow owner to proceed with addition. KJ seconded. 3 yes. 7. Aram Conragan-failure to test alternative septic system for 78 Old Red Top Road It was noted that Mr. Conragan had a different company doing the testing and that the company stated that they had been doing the inspections and entering all the information on the Carmody system. NI will check into that. 8. Request to keep septic system less than 300' from pond for 33 Governor Prence Road Although the septic inspection passed, the system is from the~0's and would not be acceptable for what the owner is proposing to do. Motion: AP-deny request. If owner wants to go through with addition, he will have to upgrade the. septic system. KJ seconded. 4 yes. 9. Paul Lively-food establishment application for "Chef Paul's Cuisine" on Main Street Mr. Lively handed out a revised proposal to the Board. He would like to open a Gourmet Chocolate Shop with a sit down chocolate tasting table. He is also proposing a catering service out of the kitchen. NI stated that she still needs to review the septic system file to make sure it is adequate for what he is proposing. Mr. Lively also needs to get his wholesale license prior to opening this shop. Motion: JR-approve the application with the stipulation that he gets all the proper permits, all of the Assistant Health Directors recommendations are met and the septic system is reviewed. AP seconded. 4 yes. 10. Discuss Brewster's Comprehensive Emergency Management Plan "Chairman" needs to be changed to Health Director in plan. A few other changes should be made also. 11. Discuss Harwich & Chatham's Regulations regarding sub divisions & shared septic systems. The Board agreed to write a regulation like Harwich, make it Town wide for 5 or more lots in a subdivision.
