GENERAL ORDINANCE NO. 74-1978
AN ORDINANCE TO REGULATE AND CONTROL THE USE OF GUNS OR OTHER
INSTRUMENTS WHICH LAUNCH AN OBJECT OR PROJECTILE BY THE USE OF
COMPRESSED GAS OR AIR OR OTHER MECHANICAL MEANS.
WHEREAS, it is necessary for the protection of the health, safety
and welfare of the people of and property within the corporate limits
of the City of Richmond, Indiana, to regulate the use of air guns,
gas guns and similar instruments; and
WHEREAS, the State of Indiana, by definition does not control the sale
or use of air guns, pellet guns, sling shots or other instruments which
launch an object or projectile by the use of compressed gas, air or
other mechanical means, hereinafter called guns.
NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
RICHMOND, WAYNE COUNTY, INDIANA:
1. That the firing of any gun, or the launching of any object or
projectile by means of compressed gas or air, or by any mechanical
device within the corporate limits of the City of Richmond, Wayne
County, Indiana, by any person who recklessly, knowingly, or
intentionally creates a substantial risk of bodily injury to
another person or damage to property of another person or injury or
death to an animal is hereby prohibited.
2. That any gun, air gun, pellet gun or mechanical device fired or
used, contrary to Section one (1) hereof, within the corporate limits
of the City of Richmond, Wayne County, Indiana, shall be confiscated
by the police department of said city.
3. That any person who violates Section one (1) of this Ordinance
shall be guilty of an infraction of the Municipal Code of the City
of Richmond, Indiana.
4. That any person who is found guilty of an infraction of Section'
one (1) or Section five (5) of this Ordinance shall forfeit all right
to ownership of any gun, air gun, pellet gun, or mechanical device
used in the infraction of said Section one (1) of this Ordinance.
5. That any person who owns a gun, air gun, pellet gun, or mechanical
device which person permits another person to fire or use said gun or
device as to allow said person other than owner to be guilty of an
infraction of Section one (1) of this Ordinance shall be guilty of an
infraction of the Municipal Code of the City of Richmond, Indiana.
6. That this Ordinance shall be known as Chapter 46, Sections 11-19,
of the Municipal Code of the City of Richmond, Indiana.
7. That any person who shall be guilty of an infraction of Chapter 46,
Sections 11-19, or of Section one (1) or five (5) of this Ordinance
shall be fined not less than Ten Dollars ($10.00) nor more than
One Hundred Dollars ($100.00).
8. That any section, clause, phrase or word which shall be declared
invalid by any court shall be hereby declared to be deleted herefrom
and such invalidity of such section, clause, phrase or word shall not
render the remainder invalid.
9. That this Ordinance shall be in full force and effect after being
passed and adopted by the Common Council of the City of Richmond,
Indiana, and published as required by law.
