THE BREWSTER BOARD OF HEALTH REGULAR MEETING
TUESDAY, JUNE 3, 2008 AT 7:OOPM

Present: Dan Brightman, Joanne Hughes, James Reynolds, Keith Johnson, Nancy Ellis Ice, Health Director
and Tammi Mason, Administrative Clerk
1. Reorganization of the Board
Dan Brightman nominated Joanne Hughes for Chairman. JR seconded. 4 yes.
Joanne Hughes nominated Dan Brightman for Vice Chairman. KJ seconded. 4 yes.
Nothing will change as far as Board members on other committee's.
2. Minutes from 4/ 1/08
Motion: DB- approve minutes. JR seconded. 3 yes.
3. Minutes from 4/22/08
Motion: JR- approve minutes. DB seconded. 4 yes.
4. Minutes from 5/6/08
Motion: DB- approve minutes. KJ seconded. 4 yes.
5. Frank Prete-oil tank variance request for 19 Landing Lane
Motion: JR-grant variance. DB seconded. 4 yes.
6. East Cape Engineering-request to keep existing septic system for addition & to allow the system to be
less than 300' from pond
This item was previously heard by the Board but the applicant was not present and did not get a chance to
speak. Chris Wixon from East Cape was present to represent the owners. The house was built some time in
the 80's and subsequent additions were done with CO's issued. There are no changes in the footprint
proposed at this time except for a bump out to make a room larger. This house has been a 6 bedroom home
since 1989.
Motion: DB-grant applicant permission to do his addition with the current septic system and keep the
system where it is (less than 300' from pond). If the system should fail, the homeowner would need to
apply for a variance to put the new septic system 300' from pond. JR seconded. 4 yes.
7. Discuss Pets Banned from Beaches regulation & opinion from Town Counsel
NI told the Board that Town Counsel stated that a public hearing is not necessary. The Board decided not to
have one.
Motion: JR-adopt the amended regulation. KJ seconded. 4 yes.

8. Lisa Lyons-variance request for 2146 Main Street
KJ recused himself from this hearing due to a conflict of interest. LL explained that this is a small lot with
wetland issues. The lot has a well on it. There will be no increase in flow or square footage. Conservation
Commission has given their approval. Town water may be available sometime in June (owners want to switch
over to town water once available). The current septic system is in failure. The following variances are being
requested:
1. 89' to existing private well
2. 13' from sas to foundation
3. 5' from sas to property line
4. septic tank 97' from river's edge
5. sas 103' from river's edge
Motion: JR-grant variances with Environmentally Sensitive Area restrictions applying. DB seconded.

J.M. O'Reilly-request to have septic system less than 300' from pond at 3137 Main Street
KJ recused himself from this hearing due to a conflict of interest. Keith Fernandes and John O'Reilly were
present to represent the client. The current septic system will be upgraded to Title 5 but they cannot meet
300' setback to the pond. Conservation Commission has already approved this project.
Motion: DB-grant variance. JR seconded. 3 yes.
10. Charles Madansky-request to use existing septic system for addition at 196 Nan Ke Rafe Path
The homeowner explained that this house is currently 1 bedroom and he would like to add 2 more. The
septic system is good for 3 bedrooms. The problem is that the permit application was filled out incorrectly, it
was filled out as a 2 bedroom not a 3. System was put in in 1995.
Motion: DB-grant permission to keep existing septic system for addition. JR seconded. 4 yes.
11. Discuss letter from Victor Staley re: Oceanside Septic
NI handed out a letter from Oceanside Septic that stated that their vehicles are not parked there overnight.
The Board thought this was a Zoning issue. They asked NI to check and see if any other towns have any
regulations against this type of activity.
12. Semi-public beach organizations that have not enrolled in testing program
Bruce Fulton and Sid Hooper from Brewster Dunes stated that they had enrolled in the County program.
Betty Pikering from Chapman Acres decided to talk with NI about getting in with the other surrounding semi
public beaches to do a joint test. The Board asked NI to tell the other semi-public beaches that have not
enrolled yet about the process for a State variance.
13. Discuss memo from Art Romme and letter from Zisson & Veara re: oil tanks
Noted.
14. Discuss letter from Agricultural Commission
JH suggested that the Board look into regulating the number of horses per acre. She asked that NI look into

the Harwich Regulations pertaining to this subject.
15. Discuss proposed subdivision regulations
Motion: DB-send to Town Counsel for review. KJ seconded. 4 yes.

Add on's
NI handed out the latest construction status report for project at Ocean Edge.
JH asked that NI check into whether or not Lynx has a properly sized septic system to include the tent they
have put up.
NI spoke a bit about the MRC meeting.
The Board agreed to have meetings on July 8th and 22nd and August 19th.
