HomeMy Public PortalAbout076-1978 - To Aid in the Control of Juevniles who are absent from school - StrickenAMENDED GENERAL ORDINANCE NO. 76-1978 AN ORDINANCE TO AID IN THE CONTROL OF JUVENILES WHO ARE ABSENT FROM SCHOOL CONTRARY TO LAW. WHEREAS, all persons over the age of seven and under the age of sixteen are required by law to attend public school; and WHEREAS, many persons of such age leave or do not attend school as required by law; and WHEREAS, said persons between the ages of seven years and sixteen years hereinafter called Juveniles congregate in amusement places containing pool tables, pinball machines, and electronic games or mechanical amusement devices, and WHEREAS, it is in the best interest of the health, safety and public welfare of the people of the City of Richmond to encourage school attendance. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF RICHMOND, WAYNE COUNTY, INDIANA, THAT: 1. The word Juvenile as used in this Ordinance shall mean any person under the age of sixteen years. 2. It shall be unlawful for any person owning, having care of, management of, or control of any premises wherein there is situate a pool table, pinball machine, electronic game, or any other mechanical amusement device to allow or permit any Juvenile as hereinbefore defined to: a. gather or congregate on said premises between the hours of 8:00 a.m. and 3:00 p.m., b. operate any pinball machine, or electronic game or mechanical amusement device or play pool at any time between the hours of 8:00 a.m. and 3:00 p.m. 3. It shall be unlawful for any person, firm or corporation, operating or in charge of any place of business to permit any Juvenile as hereinbefore defined to loiter, loaf, or idle in such place of business between the hours of 8:00 a.m. and 3:00 p.m. on any day when the Richmond Public Schools are in session. 4. Any person owning or having possession of any premises wherein are located pool tables, pinball machines, electronic games or mechanical amusement devices shall have the burden of ascertaining the age of any Juvenile entering said premises contrary to the provisions of this Ordinance. S. It shall be unlawful for the parent or legal guardian of any Juvenile as hereinbefore defined to knowingly permit said Juvenile to enter the premises in which are located pool tables, pinball machines or electronic games or mechanical amusement devices during the hours of 8:00 a.m, to 3:00 p.m. on any day when the Richmond Public Schools are in session. 6. It shall be unlawful for any Juvenile as defined herein to be in any room, store or place of business for the purpose of playing any game, pinball machine, electronic game or mechanical amusement device, or loafing or loitering in such place during the hours of 8:00 a.m. to 3:00 p.m. 7. Violation of this Ordinance shall be termed an infraction of the Municipal Code of the City of Richmond, Indiana, and for each infraction shall be fined not less than Five Dollars ($5.00) nor more than Fifty Dollars ($50.00) for the first offense and not less than Five Dollars ($5.00) nor more than Five Hundred Dollars ($500.00) for each subsequent infraction. 8. This Ordinance shall be known as Chapter 46, Sections 1-9, of the Municipal Code of the City of Richmond, Indiana. - 2 - 9. This Ordinance shall be in full force and effect after being passed and adopted by the Common Council of the City of Richmond, Indiana, and published as required by law.
