TUESDAY, NOVEMBER 25, 2008 AT 7:OOPM

Present: Joanne Hughes, Chairman, Dan Brightman, Vice Chairman, Keith Johnson, Nancy Ellis Ice, Health
Director and Tammi Mason, Administrative Clerk
Minutes from 10/7/08 meeting
Motion: DB-approve minutes as written. KJ seconded. 3 yes.
2. Minutes from 10/21/08
Motion: DB-approve minutes as written. KJ seconded. 3 yes.
3. Continued request for 73 Swift Lane-use of Sludgehammer system
Earl Lantry, designer, was present. This is a continued application. The Board had asked Mr. Lantry to have
the current system inspected and to get groundwater elevations. Both have been done. JH asked about the
room count.
Motion: DB-Approve plan. KJ seconded. 3 yes.
4. J.M. O'Reilly-variance request for 36 Betty's Lane
This is a 4 bedroom home which has a failed system. They will be using the existing tank which was inspected
and is fine. The following variances are being requested:
1. 5' variance from tank to property line
2. 1' variance from tank to dwelling
3. 2' variance from tank to garage
JO let the Board know that if they required the tank to be replaced, it would have to go under the driveway.
The system is well above groundwater.
Motion: DB-approve variance requests. KJ seconded. 3 yes.
5. Coastal Engineering-variance request for 224 Sheep Pond Drive
John Schniable was present. The existing system is within 300' of a pond. They are seeking a variance to allow
the system to remain where it is.
Motion: DB-grant variance. KJ seconded. 3 yes.

6. J.C. Ellis Design Co.-variance request for 135 Vesper Pond Drive
Jason Ellis was present. This is an upgrade for a property transfer but the system is within 300' of two ponds.
Motion: DB-grant variance. KJ seconded. 3 yes.
7. J.M. O'Reilly-request for expansion of home using existing septic system at Six Penny Lane
This is currently a 4 bedroom system that was installed with variances and ESA conditions applying. At the
time of installation it was stipulated that there would be no more square footage to the home allowed as part of
the Town's ESA condition regulation. What they are proposing is to reduce it to a 3 bedroom but increase the
square footage. NI spoke about DEP's letter stating that no more square footage could be added. She did
phone DEP but has not heard back from them yet.
Motion: DB-release the Town's restriction as long as DEP does not have an issue. KJ seconded.

8. Alan J. Poremba-request for extension of variance for 250 Sheep Pond Drive
Motion: DB-extend variance for one year. KJ seconded. 3 yes.
9. Oil tank variance request for 20 Zona Drive
The Board questioned whether the buyer was aware of the need to replace the tank once it reaches 10 years of
age.
Motion: DB-approve as long as buyer is aware of replacement requirements. KJ seconded. 3 yes.
10. Planning Board application for 1861 Main Street-Keevers
Noted.
11. Discuss non-compliance of testing requirements for 78 Old Red Top Road
The Board asked that NI speak with Bob Silva regarding the testing.
12. Discuss letter from Cape Cod National Golf Club re: seating capacity
The Board discussed this letter and agreed that the septic system was adequate for the current seating.
13. Discuss completed training matrix
Noted.
14. Discus letter from Town Counsel re: Massage Establishments

The Board agreed that the State should handle all aspects of the permitting process and inspections.
15. Discuss revised Zone II Deed Restriction regulation
The Board agreed that they do not need another public hearing and asked NI to bring it back to the next
meeting.
