RESOLUTION NO. 2016-02-01
A RESOLUTION RECOMMENDING APPROVAL OF THE DEVELOPMENT PERMIT FOR
WENDY'S LOCATED AT 503 SOUTH ZEREX STREET IN THE TOWN OF FRASER MORE
LEGALLY DESCRIBED AS FOLLOWS:
Parcel IV of a RESUBDIVISION OF TRACTS "A" AND "B" OF A RESUBDIVISION OF PARCEL
"C" OF FOREST MEADOWS SOLAR COMMUNITY according to the Final Plat filed November
17, 1983 at Reception No. 209971
At the special meeting of the Fraser Planning Commission held on February 10th, 2016,
Aksan United Fortune, Inc., representing Wendy's, requested approval for a Development
Permit for property located at 503 South Zerex, more legally described above; and
WHEREAS, Betty L. Storm is the landlord and owner of said property and has
authorized and approved the submission of the Development Permit application filed by Aksan
United Fortune, Inc. on behalf of Wendy's; and
WHEREAS, Aksan United Fortune, Inc. is requesting Development Permit approval to
renovate the existing unoccupied structure as follows:
• The interior will be completely gutted and a new layout will be used that will allow for the
new back of house equipment and a fresh new dining area.
• The exterior will receive new finish materials, paint and windows as needed.
• The site will only receive minor changes such as a relocation of existing telephone
pedestal box, relocating the trash dumpster enclosure and adding a freezer/cooler box
on the rear of structure.
• All plans and exterior elevations will be approved by Wendy's corporate to insure
consistency of branding initiative.
NOW THEREFORE BE IT RESOLVED that the Fraser Planning Commission has voted
to recommend approval of the Development Permit based on the representations made at the
February 10'h, 2016 Planning Commission meeting and in accordance with the documentation
that has been reviewed by the Town of Fraser with the following conditions:
1. An off-site snow storage agreement and parking agreement/easement with Craig Clark,
owner of Fraser Valley Center, shall be provided to the Town of Fraser prior to issuance
of a Certificate of Occupancy for Wendy's.
2. The additional eleven parking spaces must be relocated behind the Fraser Valley Center
prior to issuance of a Certificate of Occupancy for Wendy's.
3. Applicant to provide details on the dumpster enclosure in conjunction with building
permit.
4. In lieu of the red blade, applicant shall incorporate a stone front blade with a red band on
the top and the spandrel glass option. A 3' wainscot shall wrap the building matching
the stone front blade.
5. Applicant shall take all public comments into consideration when revising the site plan.
APPROVED AND ADOPTED THIS 10th DAY OF FEBRUARY 10, 2016.
