HomeMy Public PortalAbout108-1978 - Zoning - Special Use - 15 South 17th Streeta SPECIAL ORDINANCE NO. 108-1978 AN ORDINANCE AUTHORIZING A SPECIAL USE IN AN R-3 ONE -TO -EIGHT FAMILY RESIDENCE DISTRICT FOR A BUSINESS OFFICE ON PROPERTY LOCATED AT 15 SOUTH 17TH STREET, PURSUANT TO ARTICLE 48 OF CHAPTER 22 OF THE MUNICIPAL CODE COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA. WHEREAS, Article 22 of Chapter 22 of the Municipal Code, as amended by Ordinance No. 2987-1975, allows administrative business offices and professional offices by Special Use authoriza- tion as provided in Article 48 of said Chapter; and, WHEREAS, a notice was given and a public hearing on this Ordinance was conducted by the Richmond City Planning Commission the .::•J'", day of ` '! . ; ,'._ , , , 1978, at which time remon- strances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond Planning Commission was to t- in favor of/in-oppasitiof to recommending the passage of Ordinance No. 108-1978; therefore, BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. As provided in Articles 22 and 48 of Chapter 22 of the Municipal Code, the following described use of the following described real estate is allowed as a Special Use for a business office at 15 South 17th Street, in the City of Richmond, Indiana; more particularly described; to wit: Being a part of lot number 497 in the official map of the City of Richmond, Indiana, in the Southeast quarter of Section 33, Township 14 North, Range 1 West in the City of Richmond, Indiana, and being more particularly de- scribed as follows: Beginning at a point in the west line of lot number 497 in the official map of said City of Richmond, Indiana, said point being 94.00 feet south of the northwest corner of said lot, said northwest cor- ner being the intersection of the south line of East Main Street with the east line of South 17th Street, and running thence, from said beginning point, south 89 degrees 39 minutes east, (assuming that the west line of said lot 497 runs north and south), 147.66 feet to a point on the east line of said lot; thence south 0 degrees 05 minutes east, along said east line, 51.29 feet to the easternmost corner of said lot and the north line of 16.00 foot wide public alley; thence north 89 degrees and 43 minutes west, along the north line of said alley, and along the south line of said lot 8.10 feet to a corner of said lot and a point on the west line of a 16.00 foot wide public alley; thence south 0 degrees and 07 minutes west, along the west line of said alley, and along the east line of said lot 497, 64.00 feet to the south line of a brick garage; thence north 89 degrees and 53 minutes west, along the south line of said garage, 20.40 feet to the southwest corner of said garage; thence north 0 degrees and 07 minutes east, along the west line of said garage, 29.80 feet; thence north 88 degrees and 57 minutes west, 119.09 feet to a point in the west line of said lot 497 and the east line of said South 17th Street; thence north, along the east line of said South 17th Street, and along the west line of said lot 497, 84.09 feet to the place of beginning. y ORDINANCE NO. 108-1978 Page 2 SECTION 2. As a condition of the aforesaid Special Use and as an addi- tional restriction on said use, the following requirements shall hereafter and at all times be met by the owner, leasee or any person, firm or corporation using said real estate. SECTION 3. The Zoning Administrator of the City of Richmond, Indiana, is hereby authorized and directed, upon enactment and publica- tion of this Ordinance, to record and approve the issuance of a permit for the establishment of the use herein allowed. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval by the Mayor, and publication as by law required. Weigle, requesting Special Use at 15 South 17th Street Dear Mr. Austerman, Members of the Council and Mrs. Trimble: The Richmond City Planning Commission conducted a public searing on November 28, 1978, on Ordinance No. 108-1978, The Petitioner, Mr. Dana C. Weigle, was requesting a Special rise for proposed offices in an existing residence at 15 South llth Street. No one spoke in opposition to the petition.
