HomeMy Public PortalAbout114-1978 - Authorizing the Conveyance of certain unimproved real estate in the CityORDINANCE NO. 114-1978 ORDINANCE OF THE CITY OF RICHMOND AUTHORIZING AND APPROVING THE CONVEYANCE OF CERTAIN UNIMPROVED REAL ESTATE IN THE CITY OF RICHAIOND, INDIANA. WHEREAS, the City of Richmond, Indiana, acquired certain land by conveyance from its Department of Redevelopment as recorded in Deed Record No. 368, page 601, in the office of the Wayne County Recorder, Wayne County, Indiana; and WHEREAS, the Board of Public Works and Safety deems it desirable to convey the real estate described in Exhibit A, made a part hereof, to the City of Richmond, Indiana, for the use and benefit of its Department of Redevelop- ment to enable such department to carry out the purposes of its urban renewal plan for Central Renewal Area #1 of the City of Richmond; and WHEREAS, the Board of Public Works and Safety and the City of Richmond has no present or forseeable use for said property and the purposes described herein are in the best interest of the people of the City of Richmond, Indiana; and WHEREAS, IC 5-18-1-1 authorizes the conveyance of real estate as herein contemplated without payment of consideration by the grantee; and WHEREAS, the Board of Public Works and Safety has adopted a resolution approving the conveyance and said resolution was presented to the City Clerk for presentation to the Common Council of the City of Richmond and was so presented; now therefore, BE IT ORDAINED by the Common Council of the City of Richmond, Indiana: Section 1. It is hereby found advisable to convey the real estate described in Exhibit A hereof. Section 2. It is hereby found that the utilization of such real estate for the purposes of urban renewal will serve the public purpose and will be of benefit to the health and welfare of the City of Richmond. Section 3. The Mayor and City Clerk are authorized to execute the document offered herein on behalf of the City of Richmond and any other documents which may be necessary or desirable to complete the transaction. Section 4. The Mayor and City Clerk, acting upon the advice of the City Attorney, are authorized to make any revisions in the document herein offered which may be deemed necessary or desirable to more fully accomplish the purposes of the transaction and to execute such document or documents as revised without further submission of such revised documents to the Common Council. Section 5. This ordinance shall be in full force and effect from and after its passage and signing by the Mayor. Dickman, Mayor of the City of Richmond, Indiana, this ILAL day of 1978. f AT F)CHIBTT "A" LEGAL DESCRIPTION FOR REAL ESTATE TO BE CONVEYED BY CITY OF RICHMOND TO CITY OF RICHMOND, FOR THE USE AND BENEFIT OF ITS DEPARTMENT OF REDEVELOPMENT: The following described real estate in Wayne County, in the State of Indiana, to -wit: Being all of Lot numbered 108 and a part of Lot numbered 111 & 107 together with a part of an alley to be vacated, lying immediately north of Lot numbered 108, all in the original plat by John Smith, and a triangle part of an alley to be vacated at the northwest corner of Lot 108, all in the City of Richmond, Wayne Township, Wayne County, Indiana, and more particularly described below: Beginning at the northwest corner of said Lot numbered 108, in said original plat; thence south 89 degrees 58 minutes east 135. 43 feet to the west line of South 6th Street; thence south 5 degrees 20 minutes 20 seconds west 133.24 feet along said west line and the east lines of said Lots 108 and 111, to a point in the east line of said Lot 111; thence north 84 degrees 51 minutes 28 seconds west 134.851 feet to a point in the west line of said Lot 111; thence north 5 degrees 20 minutes 20 seconds east 121.18 feet along the west lines of said Lots 111 and 108 to the place of beginning, containing an area of 0.394 acres, more or less. RESOLUTION A RESOLUTION APPROVING THE CONVEYANCE OF CERTAIN UNIMPROVED REAL ESTATE IN THE CITY OF RICHMOND, INDIANA. WHEREAS, a certain area, described in the attached Exhibit A is needed by the City of Richmond, Indiana for the use and benefit of its Department of Redevelopment to enable such department to carry out the purposes of its urban renewal plan for Central Renewal Area #1 of the City of Richmond, Indiana; and WHEREAS, the conveyance of the area, referred to above, for the purpose requested, is in the best interest of the general welfare of the people of Richmond, Indiana. NOW THEREFORE: BE IT RESOLVED by the Board of Public Works and Safety of the City of Richmond, that: 1. the parcel of ground described in Exhibit A, hereto attached and by reference made a part hereof should be conveyed to the City of Richmond, Indiana for the use and benefit of its Department of Redevelopment, and that such conveyance is in the best interest of the people of the City of Richmond and not detrimental to the health, safety and welfare of the people of said City; and 2. those officers and/or departments of the City as are required by law, be and hereby authorized and directed to do such acts as necessary to complete the aforesaid transaction.
