CITY OF TIFFIN IOWA RESOLUTION NO. 2006- 4 7
A RESOLUTION APPROVING THE' FINAL PLA_ T OF TIMBER RIDGE VIEW
PHASE TWO, TIFFIN, IOWA
WHEREAS, LDR Iowa City, LLC (Subdivider) has filed with the City Clerk
of the City of Tiffin, Iowa, an application for approval of the final plat of Timber
Ridge View Phase Two, a subdivision of Tiffin, Johnson County, Iowa, which is
legally described as follows:
See attached Exhibit "A"
WHEREAS, the City Engineer' has examined the final plat of the
subdivision and recommends to the council, approval of the final plat subject
to the conditions set forth in the Supplemental Developer's Agreement attached
hereto as Exhibit B; and
WHEREAS, the City Attorney has examined the final plat and the
required legal documents and recommends to the -Council approval ofthe same
subject to the proper execution of the required documents; and
WHEREAS, the City Clerk has received payment of fees incurred by the
Developer for inspections by the City Engineer and for legal fees incurred from
the City Attorney; and
WHEREAS, LDR has entered into the Supplemental Developer's
Agreement (Exhibit B) with the City; and
WHEREAS, the final plat is found to conform with all of the requirements
of the city's ordinances; and
WHEREAS, the City of Tiffin will benefit from the creation of new housing
stock; and
WHEREAS, Subdivider has posted financial security to assure
compliance with its infrastructure obligations required by ordinance or by
agreements with the City; and
WHEREAS, on behalf of the City of Tiffin, Michael W. Hart, P.E., of Hart -
Frederick Consultants, P.C., has inspected and approved all improvements,

except for sidewalks, within Timber Ridge View, Phase Two, Lots 26-30 and 33-
47, Tiffin, Johnson County, Iowa, and reports that the improvements meet all
applicable City Design Standards, and recommends approval of the
improvements to the City Council; and
WHEREAS', the City desires to signify its approval of the improvements;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of Tiffin,
Iowa, that the improvements, except for sidewalks, in Timber Ridge View,
Phase Two, Tiffin, Johnson County, Iowa, are hereby approved and accepted.
The City reserves final inspection and approval of Oakdale Boulevard and Lots
3land 32.
BE IT FURTHER RESOLVED by the City Council of Tiffin, Iowa, that the
Mayor and Clerk are hereby authorized to execute the documents necessary to
approve the final plat as submitted. Further, the Mayor and Clerk are hereby
authorized to execute the legal documents submitted with the Final Plat as a
condition of its approval, including the Supplemental Developer's Agreement
attached as Exhibit B.
BE ITFURTHER RESOLVED that the City hereby releases any claim of
lien or cloud upon title based upon obligations arising out of ordinances or the
Developer's Agreement identified in the attached Supplemental Developer's
Agreement, or the Supplemental Developer's Agreement, excepting sidewalks.
BE IT FURTHER RESOLVED, that the Subdivider will record this
Resolution and subsequent legal documents with the Office of the Johnson
County Recorder.
ON THE 15th day of November, 2006, at a special meeting of the Tiffin
City Council, Tiffin, - Iowa, Councilperson W r i gh t introduced A
RESOLUTION APPROVING THE FINAL PLAT OF TIMBER RIDGE VIEW PHASE Two,
TIFFIN, IOWA,, and made a motion for approval. The motion was seconded by
Councilperson Petersen
Ayes: Petersen, Demuth, Wright, Bartels and SDils
Nays: None.
Motion carried.
WHEREUPON, the Mayor declared that A RESOLUTION APPROVING
THE FINAL PLAT OF TIMBER RIDGE VIEW PHASE TWO, TIFFIN, IOWA,
is adopted and signified his approval of the resolution by affixing his signature
below.

Marty:
Attached you'll find the revised resolution. The only change
being a specific reference to Part 3 in the waiver of dedication of
public lands. As soon as -we verify the fence agreement and you
verify the payment of fees, Glen can sign & you can return the
documents to us. We will make sure that they get recorded.
