RESOLUTION APPROVING CHANGE ORDER
WHEREAS, on August 9, 1999 the Borough of Carteret entered into a contract
with P & H Construction in the amount of $109,300.00; and
WHEREAS, the Borough Engineer has informed the Governing Body that a
modification of the contract is reasonable and necessary; and
WHEREAS, the engineer has further certified that said modifications were
unforeseen at the time the original contract was awarded.
NOW, THEREFORE BE IT RESOLVED that the sum of $28,292.50 is hereby
added from the original contract and payment of the modified amount is hereby
approved.
BE IT FURTHER RESOLVED that the Borough Engineer has certified that the
modifications which are the subject of this change order were emergent in nature
in order to protect the health, safety and welfare of the Borough residents by
preventing sewer discharges, the surcharge of the station during wet weather and
potential DEP violations, thereby permitting this change order to exceed the
twenty (20%) percent rule established by statute.
Adopted this 20th day of January, 2000
and certified as a true copy of the original
on January 21, 2000.
