A RESOLUTION APPROVING THE FINAL PLAT OF TIMBER RIDGE VIEW
PHASE ONE, A SUBDIVISION OF TIFFIN, JOHNSON COUNTY, IOWA
WHEREAS, LDR Iowa City, L.L.C., hereinafter referred to as Subdivider, has filed
with the City Clerk of the City of Tiffin, Iowa, an application for approval of the final plat of
Timber Ridge View, a subdivision of Tiffin, Johnson County, Iowa, which is legally
described as follows:
See attached Exhibit "A", hereby incorporated herein.
AND WHEREAS, the City of Tiffin will benefit from the creation of new housing
stock;

' AND WHEREAS, the City Engineer has examined the final plat and subject to the
Subdivider/Owner's compliance with certain engineering criteria that has been specified to
the Subdivider/Owner, the City Engineer recommends his conditional approval of the final
plat to the council;
AND WHEREAS, the City Attorney has examined the final plat and subject to
Subdivider/Owner's compliance with preparation of the legal documentation required by
the ordinance, the City Attorney recommends his conditional approval of the final plat to
the council;
AND WHEREAS, the City hereby acknowledges the subdivision ordinance
requirement, that five percent (5%) of the subdivision be dedicated for open space has been
met, as denoted on the final plat as Outlot "A";
AND WHEREAS, the City and the Subdivider, their successors and assigns, have
reduced to terms an' Developer's Agreement and an Amendment to the Developer's
Agreement for the subdivision; and
AND WHEREAS, the infrastructure improvements are subject to the Standby
Letter of Credit, as approved by the City Council; and
WHEREAS, the final plat is found to conform with all of the. requirements of the
city's ordinances; and
NOW, THEREFORE, BE IT RESOLVED, by the City Council of Tiffin, Iowa, that
the Mayor and Clerk are hereby authorized to execute such documents as necessary to
approve the final plat as submitted and as approved by the City Planning and Zoning
Commission, City Engineer and City Attorney, and further that the Mayor and Clerk are
hereby authorized to execute the legal documents submitted with the Final Plat as a
condition of its approval.

BE IT TURTHER RESOLVED, that the said Owner/Subdivider of this property
shall bear the cost to record this Resolution and subsequent legal documents with the Office
of the Johnson County Recorder.

ON THE 1 9y of October , 2004, ata P (regular/special) meeting of the Tiffin
City Council, Tiffin, Iowa, Councilperson Gericke • introduced' A RESOLUTION
APPROVING THE FINAL PLAT OF TIMBER RIDGE VIEW PHASE ONE, A SUBDIVISION OF
TIFFIN, JOHNSON COUNTY, IOWA, and made a motion for approval. The motion was
seconded by Councilperson Petersen

DeMuth, Gericke, Bartels, Dils and Petersen
Nays: None. ..
Motion carried.
WHEREUPON, the Mayor declared that the RESOLUTION APPROVING THE
FINAL PLAT OF TIMBER RIDGE VIEW PHASE ONE, A SUBDIVISION OF
TIFFIN, JOHNSON COUNTY, IOWA, be adopted and signified his approval of the
same by affixing his signature thereto.
PASSED, by the Council on the 19th day of October 2005, and approved by the Mayor on
the.19th day of October 2005.
