PLANNING BOARD MINUTES June 5, 1986 Members present: Evelyn Poole -Kober, Chairman; Nancy Goodwin, Barbara Page, Bob Rose, Tarleton Davis, Dr. Robert Murphy and Jim Culbreth. Members absent: Margaret Moore, Hilda Brody and Calvin -Ba-v+s ,45h1f,7. Others: Laura Hill, Zoning Officer. The Chairman called the meeting to order at 7:40. Item 1: Approval of minutes from May 1, 1986. Page made a motion to approve the minutes as read, Rose seconded it. The motion was carried and the minutes approved. Item 2: Subcommittee Reports: The Zoning Officer reported that the Orange County Planning Department had conducted a courtesy review of the Northern Fairview Community Park as requested by the Hillsborough Planning Board. Enclosed is a copy of their comments. The. Hillsborough Board of Adjustment approved the conditional use permit without any conditions except- that additional screening be added on the east side and the parking area. The minor subdivision proposed for Odie Street does have water and sewer. (Item 4, May 1st meeting.) This does not need to go to the Planning Board it was a staff review. The Greenways Committee had no report at this time, but Page suggested that there was a need for bike paths and walking trails. The Zoning Officer reported that the Historic District Commission determined that sculptures are under their preview and are working on guidelines for this. They decided that if an exhibit is up for 6 weeks or less then a Certificate of Appropriateness would not be required; 7 weeks or longer would require a Certificate. The Board of Adjustment approved modifications to the Conditional Use Permit with conditions for John Hartley on May 28.' The road Eay out will be different. Item 3: Deliberation on James Freeland rezoning request. Request is for rezoning to General Commercial, Tax Map 45, p/o Lot 4. The Zoning Officer said the current zoning is PD -OI, PD -GC and PD -GI, and covers 22 acres. The proposal is to rezone all 58.18 acres to General Commercial. The Zoning Officer stated that she did not make that recommendation because she did not feel that the applicationwas submitted in time for her to prepare an analysis. She stated her concerns were (1) the size of the area that is proposed for General Commercial; (2) access to the site; (3) the increase in traffic to the site; and (4) the amount of commercial property that is in Town already. She felt that even though the area has not been annexed yet ,hat the Board should review and provide a recommendation. Concerns of the Board were: insufficient/unknown water resources, lack of sewer at the site and the need for a pump station; the area is one of the Town's entranceways; and inadequate water pressure. Planning Board Minutes June 5, 1986 Page 2 The applicant. would have to meet the.application criteria for a General_ Commercial district which states that (1) water and sewer lines exist at the site or are to be made available as part of the development process; (2) be adjacent to land zoned G.C., G.I., O.I., or C.C.; and (3) direct access to arterial streets. The Zoning Officer stated that across the street land is zoned C.C.3 and adjacent on the other side of I-85 zoning is G.I. and the south side is zoned R.I. It does meet the requirement for access to an arterial street. Water is available to the site but sewer is not at this time. Page made a motion to deny the rezoning request due to these findings: 1) The increase in traffic and the hazardous situation that would be caused by this increase to the surrounding areas. 2) Insufficient water pressure 3) Lack of water and sewer on the site 4) Lack of study showing if more general commercial is needed in the area 5) Lack of evidence by the Town engineer that he found it in his favor. Rose seconded it. The motion ..as carried. Item 4: Deliberation on revision to Section 4.12.(e) of the Hillsborough Zoning Ordinance. Review of minimum lot size requirement for duplex dwellings. The Zoning Officer stated that the Town Board adopted an amendment to the ordinance on February 17 stating that the minimum lot size required for duplexes was 20,000 sq. ft and would still require a conditional use permit approval by the Board of Adjustment. A request was made that this item go back to public hearing with the old language of the ordinance which states that the minimum lot size be twice the lot size required for the zoning district with approval by the Board of Adjustment. The comments made at the public hearing centered around the difference between having a public hearing and a conditional use permit or a site plan. With or without a public hearing, notification in the newspaper and of property owners within 500' would still be required. Rose felt that a public hearing was still needed so that adjacent property owners could have some input into the process for their protection since this type of housing could lower their property value. Goodwin stated she felt that it was important to have twice the lot size for protection of density. Rose also stated that he felt that duplexes should not be allowed in the Historic District. Goodwin made a motion to retain the conditional use permit and increase the minimum lot size to twice the size required for that district. Rose seconded it, the motion was passed unanimously. Item 5: Board of Adjustment recommendation on ordinance revisions: The Zoning Officer said that many of the residential lots within the Town's corporate limits are long and narrow, making it difficult to meet the side yard setback requirement of 201. The Board of Adjustment has asked that the ordinance be amended'to'allow adjustments on the setbacks. June 5, 1986 Page 3 3. Placement of mobile homes on lots which are 100 feet wide. The homes must be placed length—wise on the lot in order to meet the 20' side yard J setback requirement. The Board of Adjustment asked that the setback provisions f be amended to allow adjustments based on specific guidelines. The Zoning Officer told) the Planning Board that one of the Findings that the Board of Adjustment has to make when reviewing a variance request is that the situation is unique and no use can be made of the land. The Board felt that that finding could not be made and thought the issue should be addressed in the ordinance, and asked that the Town Board review it. The Zoning Officer informed the Board of Adjustment when the matter was brought before the Planning Board that they did not wish to change the setbacks and suggested that the applicants could set the mobile homes in sideways and do additional screening. The Town Board felt that maybe some variantion should be allowed on setbacks in certain situations. The Zoning Officer is to check with the fire department and insurance companies as to their minimum distance required between buildings for insurance purposes. She stated she had hear°d the required distance is 101. - Culbreth stated that he felt the setbacks should remain as stated in the ordinance and the determination should be made if there is a real need for an amendment to the ordinance. These items have been turned over to the Town Attorney. 2. The Board of Adjustment has requested that the ordinance be amended to allow additions under certain circumstances, if the addition does not encroach further on the setback area than the existing building. Rose and Culbreth stated that they saw no problem with this. The Town Attorney is to address this issue. Item 6: Report on planning department budget proposal. The Zoning Officer reported that the position was presented to be full time. She stated that all planning would be done by the Town Administrator and the planning department. The Zoning Officer would be required to attend planning board and board of adjustment's meetings. Item 7: Zoning Violations report Unsafe building at the corner of Eno St. and W. Hill Ave. Mr. Widmar, owner of the property, and the zoning officer went out to look at the building which had burned down on a Tuesday. The building will now have to be demolished. A letter was sent to Byrd's Food Store informing them they would need a permit to display their flagging and banner. Report of trash being dumped on Tuliptree Dr. Item 8: Planning Department position and activities remaining for 1985-86. The Zoning Officer reported that an advertisement has been placed in the the paper for her position. She will have a clean copy of the ordinance printed for each of the Board's chairmans. The computer for the planning department still needs to be wired. She reported that she has completed 75% of all the sign inventory. She is working on the revisions of applications and forms used by the planning department, and well as the filing system. The report for the proposed extension of the Historic District has not been sent yet. There is still one picture that has to be taken. There are still proposed rezonings on the map that have not been done. She has received no information from the Park Valley Club in reference to this issue. Planning Board Minutes June 5, 1986 Page 4 Item 9: Review and recommendation on Pantry Area study. This item will be placed on the July agenda. Item 11: Appearance Commission that was proposed will be given to the Tree Board. The Planning Board made a recommendation that a member of their board be on the Appearance Commission and recommended Bob Rose. Item 10: The Planning Board set Thursday, June 19 as the date to have dinner with the Zoning Officer before she leaves her position with the town. The Board set July 1 at 7:30 p.m. as the time for their July meeting. The meeting was adjourned at 9:30 p.m. Minutes reported by Janet Cole.
