HomeMy Public PortalAbout2007_03_13_r039 The Town of Leesburg, Virginia PRESENTED: March 13.2007 RESOLUTION N0.2007-39 ADOPTED: March 13. 2007 A RESOLUTION: APPROVING TLSE-2006-0003, OAKLA WN CHILD CARE CENTER, PERMITTING A 10,000 SQUARE FOOT CHILD CARE CENTER USE IN LAND BAY MUC 5 OF OAKLA WN AT STRATFORD WHEREAS, Keane Enterprises, Inc. has requested special exception approval to permit a 10,000 square foot child care center in Land Bay MUC 5 of the Oaklawn at Stratford development; and WHEREAS, the property is located in the PRC, Planned Residential Community Zoning District; and WHEREAS, on November 3, 2006, the Planning Commission held a public hearing regarding TLSE-2006-0003; and WHEREAS, the child care center will benefit the public by providing education, offering intellectual stimulus and fostering emotional and social development for children from Leesburg and the surrounding area; and WHEREAS, the Planning Commission recommends approval, with the conditions set forth below. THEREFORE, RESOLVED that the Council of the Town of Leesburg in Virginia hereby approves Special Exception TLSE-2006-0003, Oaklawn Child Care Center, identified in the Loudoun County Land Records as Parcel Identification Number 233-20-3105-000, subject to the following conditions: 1. Substantial Conformance. This special exception shall be in substantial conformance with the special exception plat entitled "Special Exception Plat For Child Care Center", dated revised 03-02-2007 and prepared by Paciulli Simmons & Associates. -2- A RESOLUTION: APPROVING TLSE-2006-0003, OAKLA WN CHILD CARE CENTER, PERMITTING A 10,000 SQUARE FOOT CHILD CARE CENTER USE IN LAND BA Y MUC 5 OF OAKLA WN AT STRATFORD 2. Waivers. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual. Final plats, development plans, and construction drawings are subject to the applicable Town regulations. 3. Sight Triangle Clearance. The applicant shall keep landscape materials clear of sight triangle lines and shall meet Town of Leesburg and VDOT standards for planting in sight triangles and shall provide all necessary easements to the Town. 4. Landscape Plan. Landscape material removed due to compliance issues with sight triangles along Battlefield and Miller Drive shall be relocated within Land Bay MUC 5. 5. Sidewalk Width. The width of sidewalk that extends across the front of the child care center must be increased to six feet in the area of the two-foot overhang in lieu of providing the two- foot wide grass strip. 6. Active Outdoor Recreation Area. Portions ofthe active recreation area must be relocated outside of the area along Battlefield Parkway anticipated to be used for required landscape screen. 7. Site Lighting. All lighting fixtures used to illuminate outdoor areas including the outdoor recreation area shall be designed and directed on-site to avoid glare in surrounding areas in accordance with Design and Construction Standards Manual Section 7-670 and Zoning Ordinance Section 12.11 8. Signage. The applicant shall install signage at each non-handicap parking space (totaling ten in number) along the front sidewalk ofthe building reading "Designated for Child Pick Up/Drop off only". 9. One Way Internal Vehicular Circulation. Vehicular circulation shall occur in a counter clockwise direction around the central parking lot median as shown on the Special Exception Plat. 10. Fence. The Applicant shall install a minimum four foot black metal fence treated to withstand oxidation. No chain link, plastic, fiberglass or plywood fence materials are permitted.
