HomeMy Public PortalAbout2007_03_13_r040 The Town of Leesburg, Virginia PRESENTED: March 13.2007 ADOPTED: March 13.2007 RESOLUTION NO.2007-40 A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2006-0005, VIRGINIA COMMERCE BANK, TO PERMIT A ONE LANE BANK DRIVE THROUGH AT 341 EAST MARKET STREET, SE WHEREAS, Virginia Commerce Bank has requested special exception approval to permit a one-lane drive-through as part of a bank at 341 East market Street, SE; and WHEREAS, the property is located in the B-2 Established Corridor Commercial Zoning District; and WHEREAS, on February 1,2007, the Planning Commission recommended conditional approval of this application; and WHEREAS, on March 13, 2007 the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for a bank drive- through as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia hereby approves Special Exception application TLSE- 2006-0005, Virginia Commerce Bank Drive- Through, 341 East Market Street, SE, identified in the Loudoun County Land Records as Parcel Identification Number 231-20-4430, subject to the following conditions: Substantial Conformance: 1. Development of this special exception use shall be in substantial conformance with the Special Exception Plat titled Virginia Commerce Bank dated June 14,2006, revised through 01/04/07, prepared by Huntley, Nyce & Associates, Ltd. This plat includes Sheets 1 (Cover Sheet); Sheet 2 (Special Exception Plat); Sheet 3 (Elevations Exhibit); -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2006-0005, VIRGINIA COMMERCE BANK, TO PERMIT A ONE LANE BANK DRIVE THROUGH AT 341 EAST MARKET STREET, SE and including Lighting Levels From Adjacent Properties Photometrics Plan, dated 09/13/06 prepared by Dwyer Engineering. No Expressed or Implied Waivers: 2. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except as approved by Town Council on the Special Exception Plat. Speaker Volume: 3. Speakers used in the drive-through shall not emit sound levels in excess of the maximums established in Zoning Ordinance Section 7.9.3. Miscellaneous Site Conditions: 4. The Applicant shall repair all damage to the existing brick walls along the perimeter of the site prior to the issuance of an occupancy permit for the Drive Thru Facility. 5. The Applicant shall remove all grease containers from the existing dumpster area and remove all grease and debris from the drainage weep holes on the sides of the dumpster enclosure prior to issuance of the occupancy permit for the Drive Thru Facility. 6. The Applicant shall have all soils tested at the outfall of the existing 8 inch storm pipe and dispose of any contaminated soils as required by State regulations prior to issuance of the occupancy permit for the Drive Through Facility. 7. The applicant shall submit and obtain approval of a No Adverse Impact Plan to verify that the "Private" 8" Storm Sewer is adequate via storm calculations or design a pipe to make it adequate. 8. The applicant shall submit and obtain approval of a No Adverse Impact Plan to make the appropriate modifications to the asphalt grades as well as to the existing storm inlet in the rear of the site to ensure proper grading and drainage to prevent onsite ponding of water. 9. The applicant shall record a permanent drainage easement along the rear of their property (approximately a 10 foot wide easement as shown on an exhibit previously provided to the applicant) prior to issuance of the occupancy permit for the Drive Thru Facility. 10. The applicant shall submit and obtain approval of a No Adverse Impact Plan which shows the accessible pedestrian route from Market Street to the bank building in accordance with the drawing by Lee Phillips dated 12-14-06. 11. Upon approval of the No Adverse Impact Plan, construct improvements proposed on the plan -3- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2006-0005, VIRGINIA COMMERCE BANK, TO PERMIT A ONE LANE BANK DRIVE THROUGH AT 341 EAST MARKET STREET, SE prior to issuance of the occupancy permit for the Drive Through Facility.
