A RESOLUTION: AUTHORIZING TIME EXTENSIONS FOR COMPLETION OF PUBLIC
IMPROVEMENTS AND APPROVING PERFORMANCE
GUARANTEES FOR POTOMAC STA'.fION SECTIONS IB, lC, 3C,
AND 6EFG
WHEREAS, Mil Schottenstein Homes, Inc., the developer of Potomac Station Sections
IB, 1 C, 3C, and 6EFG has not completed all the required public improvements in accordance
with the approved construction drawings and Town standards within the two-year period agreed
to in the contract for public improvements; and
WHEREAS, this development is located in Loudoun County and the Town's bonded
improvements are water and sanitary sewer only; and
WHEREAS, the developer has requested a time extension to complete the public
improvements; and
WHEREAS, corporate surety bonds from the Liberty Mutual Insurance Company in the
amount of$5,281.10 for Section IB; and in the amount of $3,621.64 for Section lC; and from
The Continental Insurance Company in the amount of $1 0,224.94 for Section 3C; and in the
amount of $30,069.27 for Section 6EFG were provided by the developer to guarantee the
installation of public improvements; and
WHEREAS, the Town's Director of Engineering and Public Works recommends a time
extension to November 22,2007 for Sections IB, lC, and 6EFG; and to September 16, 2007 for
Section 3C.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:

AND 6EFG
SECTION I. The corporate surety bonds from the Liberty Mutual Insurance Company
in the amount of$5,281.1O for Section IB; in the amount of $3,621.64 for Section lC; and from
The Continental Insurance Company in the amount of $10,224.94 for Section 3C; and in the
amount of $30,069.27 for Section 6EFG are approved to guarantee the installation of public
improvements in these sections of Potomac Station.
SECTION II. Time extensions to November 22, 2007 for Potomac Station Sections 1 B,
1 C, and 6EFG; and to September 16, 2007 for Potomac Station Section 3C, for completion of
the public improvements are approved.
