ARESOLUTION : ESTABLISHING A STORM DRAINAGE PRO-RATA SHARE
DISTRICT FOR THE FORT EVANS ROAD STORM DRAINAGE
IMPROVEMENTS PROJECT
WHEREAS, SectionI5.2-2243 ofthe Code ofVirginia authorizes the Town of Leesburg to
collect pro-rata fees for Town-constructed drainage facilities; and
WHEREAS, the Fort Evans Road Drainage Improvement project includes the construction
of storm drainage improvements that were oversized from the existing conditions to provide for the
lO-year storm flow volume; and
WHEREAS, the total estimated cost of engineering, administration and construction of
these oversized storm drainage improvements is $1,325,314.84; and
WHEREAS, the Engineering News Record's September 2006 Construction Cost Index
Value (CCN) was 7763.15; and
WHEREAS, the properties that can bene fit from these oversized storm drainage
improvements have been identified; and
WHEREAS, the following proportional allocations by property have been determined based
on the ultimate use on each property based on current zoning and based on an existing
imperviousness "C" factor of 0.30 and a maximum imperviousness "C" factor of 0.75:

THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION 1. The Fort Evans Road Storm Drainage pro-rata share district is hereby
established, as allocated in the aforementioned table for each property and as shown on the
attached map.
SECTION II. The shares shall be adjusted by the percentage increase or decrease in
Engineering News Record Construction cost index value at the time of application. The
September 2006 Construction Cost Index Value (CCIV) from which the increase or decrease
shall be measured is 7763.15.
SECTION III. The share payment may be decreased by a percentage of the allocation
shown based on a lower imperviousness ("C" factor") as per the following calculation:

SECTION IV. The shares as specified in Section I and as modified in Section III shall be
paid prior to the issuance of a zoning permit.
SECTION V. The shares established herein shall apply to all developments within the
Fort Evans Road Storm Drainage District and the Town Manager shall maintain, for public
inspection, a record of properties subject to these fees.
