A RESOLUTION: DECLARING THAT PUBLIC NECESSITY EXISTS AND AUTHORIZING
STAFF TO ACQUIRE A PERMANENT EASEMENT NECESSARY TO
CONSTRUCT THE NORTH KING STREET STORM DRAINAGE
IMPROVEMENTS PROJECT THROUGH THE UNION CEMETERY
WHEREAS, the Council of the Town of Leesburg (the Council) finds and determines that it
is necessary to construct storm drainage improvements in the vicinity of North King Street and to
acquire easements from certain property owners, including Union Cemetery; and
WHEREAS, the easement is shown on the construction plan titled "North King Street Storm
Drainage Improvements", prepared by Paciulli, Simmons & Associates, Leesburg, Virginia; and
WHEREAS, the Town staff has met with the Union Cemetery Board to discuss the value of
the required easement on the cemetery property; and
WHEREAS, the Union Cemetery Board has requested compensation in the amount of
$1,096 plus the reconstruction of the cemetery entrance from Union and Wirt Streets; and
WHEREAS, Council finds this to be a reasonable request for compensation for the
easement.
THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. That the Town Manager, the Town Attorney, the Director of the Department of
Capital Projects Management be, and hereby are, authorized and directed to execute on behalf of the
Town an easement, in a form approvable by the Town Attorney, to acquire by purchase the
referenced easement over the land aforesaid from Union Cemetery, their successors and assigns, in
the locations shown on the construction plan for $1,096 plus the reconstruction of the entrance to
Union Cemetery from Union and Wirt Streets.

SECTION II. That funding for the purchase price by agreement and the expenditure of such
funds for the said easement and all other acquisition costs, be, and hereby is, authorized and
approved.
SECTION III. That the Clerk of Council be, and hereby is, authorized and directed to affix
the seal of the Town to such documents as may be necessary or convenient to accomplish the
acquisition of the rights-of-way and easements as required by this resolution.
