HomeMy Public PortalAbout2007_03_27_r047 The Town of Leesburg, Virginia PRESENTED: March 27, 2007 RESOLUTION NO. 2007-47 ADOPTED: March 27, 2007 A RESOLUTION: APPROVING TLSE-2006-0008, UNION CEMETERY, PERMITTING AN EXPANSION OF THE CEMETERY USE WITHIN THE R-1 RESIDENTIAL SINGLE F AMIL Y ZONING DISTRICT WHEREAS, Union Cemetery, Inc. has requested special exception approval to permit an expansion of the cemetery use at 30 Union Street NW; and WHEREAS, the property is located in the R-1, Residential Single Family Zoning District; and WHEREAS, on March 27, 2007, the Planning Commission and Town Council held a joint public hearing regarding TLSE-2006-0008; and WHEREAS, the request complies with the Town Plan and staff recommends approval; and WHEREAS, on March 27,2007, the Planning Commission recommended approval of TLSE-2006-0008 4-3-0; and WHEREAS, The Council has concluded that the approval of the application would be in the public interest and in accordance with sound zoning and planning principles. THEREFORE, RESOLVED that the Council of the Town of Leesburg in Virginia hereby approves Special Exception TLSE-2006-0008, Union Cemetery Expansion, identified in the Loudoun County Land Records as Parcel Identification Number 230-28-1114-000, subject to the following conditions: 1. Substantial Conformance. Development of this special exception use shall be in substantial conformance with the special exception plat dated revised 9/1/06 titled "Special Exception Plat on the property of The Union Cemetery" and prepared by Gordon Associates. -2- A RESOLUTION: APPROVING TLSE-2006-0008, UNION CEMETERY, PERMITTING AN EXPANSION OF THE CEMETERY USE WITHIN THE R-1 RESIDENTIAL SINGLE F AMIL Y ZONING DISTRICT 2. No Modifications Granted or Implied. Approval of this special exception application does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, Zoning Ordinance, or Design and Construction Standards Manual except as set forth in these conditions. Final plats, development plans and construction drawings are subject to the applicable town regulations. 3. Minor Site Plan. A Minor Site Plan shall be submitted and approved by the Town of Leesburg prior to commencement of construction of the cemetery expansion. Modifications to the existing grades shall be shown and all aspects of storm water run-off, storm water management and BMP shall also be included for review. 4. Fencing. The Union Cemetery Trustees shall install a 4-foot fence ofundesignated type no later than three years from the date of approval of this special exception by Town Council along the boundaries of the proposed expansion under different ownership.
