HomeMy Public PortalAbout2007_03_27_r052 The Town of Leesburg, Virginia PRESENTED March 27,2007 RESOLUTION NO. 2007-52 ADOPTED March 27, 2007 A RESOLUTION: TERMINATING THE TOWN/OAKLA WN ROAD CONSTRUCTION AGREEMENT WHEREAS, the TownlOaklawn Road Construction Agreement dated March 28, 2005 was authorized by Town Council Resolution No. 2005-44; and WHEREAS, the Road Construction Agreement was intended to move the Town's Sycolin Road Widening Project forward on an accelerated path for benefit of SE residents and efficient use of tax dollars; and WHEREAS, Oaklawn solicited bids for construction ofthe Sycolin Road Widening Project in accordance with the Road Construction Agreement; and WHEREAS, KB Contracting, LLC of Fairfax Station, Virginia was awarded the construction contract with the consent of the Town; and WHEREAS, during construction it became apparent that KB Contracting was not able to meet the requirements of the specifications for constructing the Sycolin Road Widening Phase I project; and WHEREAS, all three parties; Oaklawn, Town of Leesburg, and KB Contracting agreed that it was in the best interest of all involved to terminate the existing agreements; and WHEREAS, the Town with Oaklawn's consent repackaged the project, now Sycolin Road Widening Phase I-A, and advertised for construction consistent with the VPPA; and WHEREAS, Oaklawn has contributed their "full share" dollar amount as outlined in the Road Construction Agreement. -2- A RESOLUTION: TERMINATING THE TOWN/OAKLA WN ROAD CONSTRUCTION AGREEMENT THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The Road Construction Agreement is hereby terminated. SECTION II. The Town Manager is authorized to execute the TownlOaklawn Termination Agreement in a form approved by the Town Attorney.
