HomeMy Public PortalAbout2007_04_10_r057 The Town of Leesburg, Virginia PRESENTED: April 10, 2007 ADOPTED: April 10, 2007 RESOLUTION NO. 2007-57 A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2006-0006, CATOCTIN CIRCLE CENTER, TO PERMIT A PRIVATE PARKING STRUCTURE AT CATOCTIN CIRCLE NEAR EDWARDS FERRY ROAD, NE WHEREAS, Arcadia Development Company has requested special exception approval to amend special exception TLSE-2004-0007 to permit a change in the height of the private parking structure at Catoctin Circle near Edwards Ferry Road, NE; and WHEREAS, the original parking structure height is approximately 21 '7" tall and the revised height is approximately 33' tall; and WHEREAS, the Zoning Administrator determined that the revised garage height is not in substantial conformance with the approved height and therefore the special exception must be amended; and WHEREAS, the property is located in the B-2 Established Corridor Commercial Zoning District; and WHEREAS, on March 15,2007, the Planning Commission recommended conditional approval of this application; and WHEREAS, on April 10, 2007 the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for a private parking structure as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia hereby approves Special Exception application TLSE- 2006-0006, Catoctin Circle Center Private -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2006-0006, CATOCTIN CIRCLE CENTER, TO PERMIT A PRIVATE PARKING STRUCTURE AT CATOCTIN CIRCLE NEAR EDWARDS FERRY ROAD, NE Parking Structure, Catoctin Circle, NE, identified in the Loudoun County Land Records as Parcel Identification Number 188-26-1371, subject to the following conditions: Substantial Conformance: Development of this special exception use shall be in substantial conformance with the Special Exception Plat titled "Revised Special Exceptionfor Parking Structure Catoctin Circle Center" dated 11/10/06, prepared by William H. Gordon Associates, Inc. This plat includes Sheet 1 (Cover Sheet); Sheet 2 (Special Exception Overall Map); Sheet 3 (Parking Structure Special Exception Plat); Sheet 4 (Line of Sight Exhibit); Sheet 5 (Landscape Exhibit); Sheet 6 (Site Lighting Exhibit); EG3.3 (7. Lighting Plan - Parking Garage); E1.2 (8. Lighting Plan - Existing Fixture Schedule); A3.1 (9. Floor Plan - Lower Level); A 3.2 (10. Floor Plan - First Floor); A3.3 (11. Floor Plan - Second Floor); A3.4 (12. Floor Plan - Third Floor); A4.1 (13. Parking Structure Elevation); A4.4 (14. Parking Structure Elevation); A4.5 (15. Parking Structure Elevation), 15 sheets total. No Expressed or Implied Waivers: Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except as approved by Town Council on the Special Exception Plat. Final plats, development plans and construction drawings are subject to the applicable town regulations. Inoperable Vehicles: The parking structure shall be used solely for the parking of vehicles in operating condition. No motor vehicle parking repair work except emergency service shall be permitted in association with a parking facility. Site Lighting: Lighting on the top deck of the parking structure shall be recessed into the parapet walls except along the west elevation adjacent to the proposed office building, (Building A) where the fixtures shall be wall-mounted. Pole-mounted lights shall be prohibited on the top deck of the parking structure. Surface Drainage: Should the 6-foot high buffer-yard wall impede the surface drainage of the single-family dwellings along Edwards Ferry Road or the apartment open space, it shall be the responsibility of the applicant to mitigate that impediment to allow proper surface drainage. Cross Parking Easement: A reciprocal cross parking easement shall be executed by all lot owners of the Catoctin Circle Centre development prior to issuance of a zoning permit for the parking structure. Wire Mesh Screen: A wire mesh screen shall be installed in the openings on the east fayade of the parking structure facing the Public Safety Center property. In addition, an eight foot tall wire mesh screen shall be installed on the top level parapet wall.
