HomeMy Public PortalAbout2007_04_24_r067 The Town of Leesburg, Virginia PRESENTED: April 24. 2007 ADOPTED: April 24. 2007 RESOLUTION NO. 2007-67 A RESOLUTION: APPROVING TLSE-2007-0001, LOUDOUN COUNTY TEMPORARY COMMUTER PARKING LOT, PERMITTING AN EXTENSION OF THE COMMUTER PARKING LOT USE AND REVISING TLSE-2005-0001. WHEREAS, Loudoun County Office of Transportation Services has requested special exception approval to permit a continuation of a temporary commuter parking lot on the former Barber and Ross Company site at 110 Catoctin Circle, SE; and WHEREAS, it is the intent and desire of the Town Council to consider the possibility of temporary commuter parking facilities in the Town of Leesburg; and WHEREAS, on April 24, 2007, the Town Council amended the Zoning Ordinance to permit temporary commuter parking lots on a particular site longer than two years with approval of an additional special exception; and WHEREAS, the proposed use meets the special exception standards for a temporary commuter parking lot as set forth in the Zoning Ordinance; and WHEREAS, on March 19,2007, the Planning Commission recommended approval ofTLSE- 2007-0001,5-0-2; and WHEREAS, staffrecommends approval of this request with the conditions set forth below; and WHEREAS, The Council has concluded that the approval of the application would be in the public interest and in accordance with sound zoning and planning principles. THEREFORE, RESOLVED that the Council of the Town of Leesburg in Virginia hereby approves Special Exception TLSE-2007-0001, Loudoun County Temporary Commuter Parking Lot, identified in the Loudoun County Land Records as Parcel Identification Number 231-19-3353; 231-19-6022; and 231-19-6044, subject to the following conditions: 1. Substantial Conformance. Development of this special exception use shall be in substantial conformance with the special exception plat dated 12-5-06 Revision Special Exception -2- A RESOLUTION: APPROVING TLSE-2007-0001, LOUDOUN COUNTY TEMPORARY COMMUTER PARKING LOT, PERMITTING AN EXTENSION OF THE COMMUTER PARKING LOT USE AND REVISING TLSE-2005-000 1. Extension entitled "Barber & Ross Site Commuter Parking Lot Layout Special Exception Plat" and prepared by TRI- TEK Engineering. 2. No Modifications Granted or Implied. Approval of this special exception application does not express or implies any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, Zoning Ordinance, or Design and Construction Standards Manual except as set forth in these conditions. Final plats, development plans and construction drawings are subject to the applicable town regulations. 3. Industrial Court Access. The Industrial Court entrance shall be paved from the apron of the public right of way to the existing paved area on site to provide a continuous paved travel lane for bus traffic. 4. Harrison Street Access. Upon expiration of the right-of-way permit, the applicant shall remove the entrance to Harrison Street by effectively blocking this access via secured fencing. 5. On-Site Parking. All parking areas will remain as is, either paved or graveled. All spaces shall be demarcated via striping if paved and wheel stops where graveled providing clear site circulation patterns. 6. Parking Aisles. The applicant shall maintain a minimum parking aisle width for two (2) way traffic at 24-feet when utilizing 90 degree parking spaces. 7. Lighting. Lights shall remain on a timer system from dust to dawn with provisions for Daylight Savings Time. Lighting fixtures shall not have a source of illumination that is visible beyond the site or cause illumination of adjacent properties in excess of 0.5 foot-candles, as measured at the site boundary (DCSM Sec. 7-670.1). 8. Perimeter Fence Line. The applicant shall maintain the perimeter fence line clear of overgrowth and provide for clear surveillance of the site at all times. 9. Parking Lot Condition. The applicant should repair and perform regular maintenance within the existing gravel portion of the parking lot to eliminate the pot holes and washboard ruts. 10. Temporary Commuter Parking Lot use. Parking on this lot is permitted and established only in conjunction with the Loudoun County mass transit and car pooling programs. The use shall cease to exist upon vacation of the site by Loudoun County or within 30 days of completion of the Bolen Park site, whichever occurs first. PASSED this 24th day of April 2007.
