HomeMy Public PortalAbout2007_04_24_r069 Perf Guar Lansdowne on the Potomac Sec 40-41 and Riverside Pkwy The Town of Leesburg, Virginia RESOLUTION NO. 2007-69 PRESENTED: April 24. 2007 ADOPTED: April 24. 2007 A RESOLUTION: ACCEPTING THE PUBLIC IMPROVEMENTS, RELEASING THE PERFORMANCE GUARANTEES, AND APPROVING MAINTENANCE GUARANTEES FOR LANSDOWNE ON THE POTOMAC SECTIONS 40 & 41; RIVERSIDE PARKWAY PHASE 4 & 5; AND THE WATERMAIN EXTENSION WHEREAS, Lansdowne Community Development, LLC, the developer of Lansdowne on the Potomac Sections 40 & 41; Riverside Parkway Phase 4 & 5; and the Watermain Extension have completed the public improvements in accordance with approved plans and Town standards and these have been inspected and approved; and WHEREAS, this development is located in Loudoun County and the Town's bonded improvements are water and sanitary sewer only; and WHEREAS, the Director of Engineering and Public Works recommends accepting the public improvements and approving maintenance guarantees for Lansdowne on the Potomac Sections 40 & 41; Riverside Parkway Phase 4 & 5; and the Watennain Extension. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION 1. The corporate surety bonds from the GulfInsurance Company in the amount of in the amount of $36,440.00 for Sections 40 & 41; in the amount of$7,635.60 for Riverside Parkway Phase 4 & 5; and in the amount of$2,852.30 for the Watermain Extension, are released, and new securities in a form approved by the Town Attorney for a maintenance guarantee in the amount of$18,220.00 for Sections 40 & 41; in the amount of$I,426.15 for Riverside Parkway Phase 4 & 5; and in the amount of$3,817.80 for the Watermain Extension -2- A RESOLUTION: ACCEPTING THE PUBLIC IMPROVEMENTS, RELEASING THE PERFORMANCE GUARANTEES, AND APPROVING MAINTENANCE GUARANTEES FOR LANSDOWNE ON THE POTOMAC SECTIONS 40 & 41; RIVERSIDE PARKWAY PHASE 4 & 5; AND THE W A TERMAIN EXTENSION from the Lexon Insurance Company are approved, and shall be in effect for a period of one year from this date. SECTION II. This release is contingent upon delivery of a properly executed instrument conveying unto the Town all such improvements and easements free of any liens or charges.
