A RESOLUTION: AWARDING THE IDA LEE INDOOR TENNIS FACILITY
CONSTRUCTION CONTRACT
WHEREAS, the Ida Lee Indoor Tennis Facility is a funded capital project; and
WHEREAS, in response to a public solicitation for construction bids due April 11, 2007,
the Town received two bids; and
WHEREAS, the bids were evaluated by the Director of the Department of Capital Projects
Management and the Chief Purchasing Officer in accordance with the Town's Purchasing Policy;
and
WHEREAS, Tessa Construction & Tech Company, LLC was determined to be the lowest
responsive and responsible bidder with a base bid of $2,472,692; and
WHEREAS, Capital Construction Corporation was determined to be a non-responsive
bidder; and
WHEREAS, the lowest responsive and responsible bid received exceeded the available
budget; and
WHEREAS, staff negotiated both the scope and unit prices with Tessa Construction in
accordance with the bid documents; and
WHEREAS, the negotiated price will include the construction of the four court indoor
tennis facility and the related site work; and

WHEREAS, the winterization of the existing pavilion and site lighting will not be
constructed at this time but may be bid separately as smaller projects for better pricing at a later
date; and
WHEREAS, the final negotiated price for this contract is $1,791,340; and
WHEREAS, this is a unit price contract and the estimated quantities multiplied by the unit
price have established the not to exceed contract price; and
WHEREAS, change order procedures are detailed in the bid specifications; and
WHEREAS, sufficient funding is available to award this contract.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the
Town Manager is authorized to execute a contract, in a form approved by the Town Attorney, with
Tessa Construction & Tech Company, LLC, in the amount of$1,791,340 for the construction of
this proj ect.
