A RESOLUTION: DIRECTING STAFF TO DEVELOP AN ORDINANCE TO ESTABLISH AN
UTILITY RATE ADVISORYCOMMITTEE FOR THE TOWN OF LEESBURG
RESOLUTION NO. 2007-85
WHEREAS, the Town Council would like to establish an open process for the establishment of
utility rates, availability fees, and related surcharges or discounts;
WHEREAS, the Council believes that the best way to achieve an open process would be to
provide public involvement of customers of the system;
WHEREAS, the Council believes that the establishment of an advisory rate committee comprised
ofin-Town and out-of-Town customers would provide all users of the system the best opportunity for
knowledge of and involvement in the review of information that results in the establishment of a
comprehensive utility rates structure; and
WHEREAS, the Council recognizes that any recommendations regarding rate structures must
meet the necessary financial performance established in existing and proposed bond covenants, the
Town's fiscal policy, and generally accepted best financial management practices and that would in no
way jeopardize the General Fund or Utility Fund credit ratings.
THEREFORE, RESOLVED that the Council of the Town of Leesburg in Virginia:
SECTION I. Directs staff to develop an ordinance that establishes a Utility Rate Advisory
Committee comprised of nine (9) members, which will include seven (7) in-Town members and two out-
of- Town representatives, especially encouraging participation by professionals knowledgeable in the
areas of utilities and/or finance.
SECTION II. The duty of the committee is to annually review the relevant information provided
by staff necessary for the establishment of utility rates and provide a recommendation to the Town
Council so that rates can be established as part of the Town's annual budget process.

SECTION III. The initial review of rates is to take place no later than October 31, 2007 with
subsequent reviews to be completed by January 31 of each year.
SECTION IV. The initial review will include a review of the rate structure to determine the most
appropriate structure; a review of current expenses and identify possible savings; a review of the rate
structure for connection fees.
