ITEM #1: Consideration of additions to the agenda FOR RECOMMENDATION TO THE TOWN BOARD: ITEM Rezoning request by John & Corenthia Wright -to 22,500 square feet on the south side of Hwy 70., R-10 to GC (General Commercial) 4.14.A.5 & 6A. ITEM #3: Changes to the text of the Zoning Ordinance: rezone approx. 2 lots from 1. Minor changes for clarification and administration to Section 12.5, Historic District Commission, which would allow for notification of applicant by first class mail or personal delivery for all applications, and require review of applications within 60 days;' 2. Require side and rear setbacks in the OI (Office -Institutional) zoning district of 20 feet, Section 3.5; 3. Changes to Section 11, Amendments, to allow the Board of Adjustment to bring an amendment to Public Hearing and to require the Zoning Officer to prepare a recommendation after the Public Hearing; 4. Changes to Section 8, Signs, which include: a. Allow additional flags to be erected, Section 8.4.b, b. Place a maximum size on church signs, Section 8.4.g, C. Allow banners to be erected for grand openings, Section 8.4. d. Exempt signs integral to a structure from square footage requirements if in place at the time of this amendment, Section8. 11. d, e. Require nine foot clearnace of hanging signs above'the sidewalk, Section 8.15.c.ii, f. Allow for notification by certified mail or personal delivery and allow for removal.of signs by Feb. 17, 1989 as stated in Section 8.8.6, Section 8.16, g. Allow for Board of Adjustment review for non-profit, public event signs that are in excess of the minimum requirements; 4 dawn of lifflobarou94 HILLSBOROUGH, NORTH CAROLINA 2-1278 AGENDA NOVEMBER 5, 1987 PAGE 2 ITEM #4: Change the eastern boundary line of the Historic District to end at the rear of the lots on Thomas Ruffin St.; ITEM #5: Addition of -Section 5.18.2.b to allow for conditions for and requirements of a Minor Site Plan Review to be administered by the Zoning Officer; ITEM #6: Review of the updated Zoning Map in preparation for official adoption; - --- ITEM #7: Discussion of the proposed Subdivision Regulations and Appendix; ITEM #8: Recreation Plan and Recreation Service Area'map. ITEM #9: Courtesy Review from Orange County for the Marvin McPherson Major Subdivision on the west side of Nash -St. - 8 lots plus one lot for open space, a new road called Glovenia Lane. 4.28.A.20, 20A, 20B, and part of 19. (attachments) ITEM #10: Courtesy Review from Orange County for a Planned Development for Chandler Conrete to provide compliance with the Orange County Zoning Ordinance. (attachments) ITEM #11: Discuss of Parking Section of the Zoning Ordinance, especially as it regards the size of a parking space - should we allow for compact size 7.5' �,­ 15' spaces. (attachments) ITEM #12: Approval of the minutes otf -the October 1, . 1987 meeting. NOTE: Due to expenses in advertising and untimely delays, it is imperative to have a quorum at this meeting. If you cannot attend, please contact Janet Rigsbee as soon as possible. Two Planning Board members cannot attend the Public Hearing so we are counting on everyone's positive response. MINUTES PLANNING BOARD NOVEMBER 5, 1987 MEMBERS Bob Rose (Chair), Barbara Page, Ida Louise Evans, Dr. Robert PRESENT: Murphy, Calvin Ashley, Tarleton Davis, Cheshire Cole, Jim Culbreth, Margaret Moore OTHERS: Cindy Wolfe, Mr. A.W. Kenion,.Janet Rigsbee ADDITION: Hilda Brody, out-of-town member has resigned as she is moving to another county. Rose will write a letter of appreciation. ITEM #2: Barbara Page and Dr. Murphy had read the minutes of the Public Hearing regarding.the following Public Hearing Items 2-8. The rezoning request for John and Corenthia Wright to rezone approx. 22,500 square feet on the south side of Hwy 70, 2 lots from R-10 to GC (4.14.A.5 & 6) was considered for recommendation. Rigsbee read her prepared analysis and recommendations (attached). Evans asked for clarification on the driveway problem and Rigsbee responded that the driveway has a severe angle off of Hwy 70. Evans asked about the Home Occupation and Rigsbee said that only 1 other person not residing in the home may work at a home occupatio Evans noted that the Snake Den is across the street and said that the Wright's were older folks and will live there their whole life. Rose said that a rezoning goes in perpetuity and runs with the land. Page moved that as zoning goes with the land to recommend denial with the 5 points that Rigsbee brought forth. Ashley seconded. Vote 8-1 with Evans voting against. ITEM:#9: Rigsbee presented the Courtesy Review from Orange -County of`the Marvin McPherson Major Subdivision on the west side of Nash St. - 9 lots and.<a new road called Glovenia Lane (4.28.A.20,20A,20B). She explained that the one lot that was to be dedicated for open space has been made into.a building lot. Evans moved to approve the subdivision as presented. Culbreth seconded. Unanimous. ITEM #3: Rigsbee reviewed the zoning text amendments 3-1 through 3-4. There was little discussion as the Board was very familiar with the amendments. The only discussion was about charging non-profit organizations $10. for a sign variation. The conclusion that a fee of $10. is not a deterrent to requesting a sign variation and the fee should be deleted. Ashley moved to recommend approval of all text amendments in #3 with the additional recommendation to delete the $10. charge on sign variations. Page seconded. Unanimous. s November 5, 1987 Page 2 ITEM #4: Culbreth moved to recommend approval to change the eastern boundary line of the Historic District as presented. Cole seconded. Unanimous. ITEM #5: Page moved to recommend approval of the addition to the Zoning Ordinance of a new section 5.18.2.b to allow for conditions for and requirements of a Minor Site Plan Review. Ashley seconded. Unanimous. ITEM #6: Davis moved to recommend approval of the updated Zoning Map. Ashley seconded. Unanimous. ITEM #7-8: These items had earlier been tabled by the Town Board and were not discussed at this meeting. ITEM #10: Courtesy Review from Orange County for a Planned Development for Chandler Concrete was presented by Rigsbee. Page moved to recommend denial of the request as Chandler Concrete has not been a good corporate neighbor and they do not need more room to plant trees and that a driveway maintenance agreement should be executed and that concrete on Hwy 10 to be kept cleaned up. Ashley seconded. Unanimous. ITEM #11: Parking will be discussed at the December meeting. ITEM #12: Page moved to approve the minutes of the October 1, 1987 meeting. Davis seconded. Unanimous. Janet V. Rigsbee, Planning Director S JOHN AND CORENTHIA WRIGHT REZONING REQUEST PUBLIC HEARING COMMENTS: See attached minutes. ANAT.YSTS The problems in rezoning this property to GC are: 1. The location of the house has not been established in relation .to the proposed rear boundary of the GC zoning district which is 150' south of Hwy 70. Indeed, there is a drawing submitted by Mr. Wright that shows the house in the setback and from the 1986 file there is a drawing which shows the house straddling the proposed GC district line (attached). If the Board favors rezoning it should be contingent upon the Wright's presenting a survey showing the location of the house and the compliance with setback requirements. 2. Upon consultation with Phil Green, Institute of Government, it appears that it would be unwise to rezone this property to commercial as the zoning concept is based on using streets, streams, property lines as anchors for zoning boundaries. In this instance, Hwy 70 is the zoning boundary with all property to the north of Hwy','70 zoned commercial and all property south of Hwy 70 in this neighborhood zoned residential. 3. There is a safety hazard existing on the property in that the angle of the driveway is severely angled. If the Board favors rezoning, it should be contingent upon the Wright's redesigning their driveway wi,th the Dept. of Transportation's approval. 4. This property is not adjacent to lands zoned OI, GC, or CC as required in the Zoning Ordinance. The property is adjacent to R-10 and across the street from GC. 5. In 1986, a similar rezoning request was presented for this property and was denied. There has been no significant change since that time to make the rezoning more favorable. RECOMMENDATIONS 1. The Town take an active rgle in pursuing the "clean-up" and enhancement of the properties to the north of Hwy 70 which currently detract from the appearance of this residential neighborhood. 2. The rezoning of this property be denied.
