HomeMy Public PortalAbout2007_06_26_r098 The Town of Leesburg, Virginia PRESENTED June 26. 2007 RESOLUTION NO. 2007-98 ADOPTED June 26. 2007 A RESOLUTION: APPROVING AN AGREEMENT WITH THE WESTMORELAND DAVIS MEMORIAL FOUNDATION FOR USE OF 28 ACRES LOCATED ALONG OLD W ATERFORD ROAD FOR A PASSIVE P ARK THAT WOULD INCLUDE LIMITED FACILITIES SUCH AS PICNIC TABLES, PARK BENCHES, NATURAL TRAILS, AND AN OFF-LEASH AREA FOR DOGS. WHEREAS, staff has been in discussion with representatives for the Westmoreland Davis Memorial Foundation for the use of28 acres along Old Waterford Road known as the Knower property for a passive park with limited facilities such as picnic tables, park benches, natural trails, and an off-leash area for dogs for Town residents at the cost of $1 a year for a 20 year lease; and WHEREAS, the proposed agreement includes the business terms that have been negotiated by the Town Manager and the Director of Parks and Recreation; and WHEREAS, a community input meeting was held on May 9, 2007 with the adjacent area including the Old Waterford Knolls subdivision; and WHEREAS, the Homeowners Association Board for Old Waterford Knolls has issued general approval of the proposed project while citing concerns with traffic, property buffer, water flow, and capital improvements to Old Waterford Road; and WHEREAS, Parks and Recreation staff is in general agreement with the concerns and will respond to the concerns as part of the development process for the park; and WHEREAS, the Parks and Recreation Director recommends approval of the agreement with the Westmoreland Davis Memorial Foundation; and -2- A RESOLULTION: APPROVING A PASSIVE PARK AGREEMENT WITH MORVEN PARK. WHEREAS, the Parks and Recreation Advisory Commission endorsed the agreement with the Westmoreland Davis Memorial Foundation with a condition of not exceeding the Town's financial contribution of$50,000 for the development of the park that was appropriated by Town Council as part of the FY2008 budget, and a condition that a friends group be established to solicit additional funding for the park and to assist in the operations of the park; and WHEREAS, a public hearing on the matter was held at the Town Council Meeting on Tuesday, June 26,2007; and WHEREAS, if the action is approved by Town Council, the representative for the Westmoreland Davis Foundation will draft a formal lease agreement for review and approval by the Town Attorney. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the draft agreement for a passive park with the Westmoreland Davis Memorial Foundation is hereby approved, with the formal lease to be drafted by the Westmoreland Davis Foundation for review and approval by the Town Attorney.
