Seconded by Tubman Vote: All Aye TOWN OF BREWSTER MINUTES OF PLANNING BOARD REGULAR MEETING Wednesday June 11, 2008 7:00 P.M. Brewster Town Office Building Chairman Henchy convened the Planning Board meeting at 7:00 pm in the Brewster Town Office Building with members Taylor, McMullen, Tubman, and Robert Barnard. Chairman Henchy opened the hearing June 11, 2008 by reading the legal advertisements and making the applicant and parties in interest aware of their rights to appeal as required under Chapter 40A, Section 17. He stated that during the hearing any member of the Board or interested party could direct questions through the Chairman to a speaker relating to the proposal. LEGAL HEARING #2008-12 -Modification of Special Permit #5014A. Applicant: Steven D. Allard - Located at 3937 Main Street, Assessors' Map 30; Parcel 13. Property is in the Village Business -proposal for the existing 2 story office building, with an office in the basement to have a change of use. Present: Steve Allard and Kathy Henchy: Read in the Department Reviews. Mr. Henchy, noted that the Conservation Dept. may need Mr. Allard to complete a certificate of compliance. In addition, the Building Commission noted several building issues that needed to be addressed. Allard: Felt the Building Dept. had a concern with the use og the 2"d floor and not the basement. Henchy: Do you have tenants in the 1S' and 2"d floor? Allard: My office has been in the basement however I have moved over to the Millstone office space. Henchy: Requested a written resolution of the Building Commissioners concerns prior to approving the application. Taylor: requested a certificate of compliance from the Conservation Department. Allard: His engineer was working with the Conservation Dept. as we speak. Taylor: Where are the wetlands? The wetlands need to be marked on the plan. Allard: He did not know it was never an issue before. Planning Board Meeting Page 1 of 2 06-11-08 Henchy: You will be changing the use of the property. The Planning Board needs to have the information kept up to date. Different uses have different impacts on the Town. Barnard: The existing permit is for retail on the first floor and an apartment on the second. Allard: Would like to see the Board recognize the first floor and the basement as retail. Tubman: Motioned to continue the hearing until Mr. Allard could supply the certificate of compliance from the Conservation Dept. and supply a letter from Building Dept. stating the issues were resolved. Second by Barnard. All Aye. ANR #2008-13 -Applicant: Catherine Clark Kroeger; Location of property: 1071 & 1095 Stony Brook Road, Assessors' Map 23, parcel 35-2. Purpose of ANR is to divide lot 4 into 2 lots. Present: Peter Soule Henchy: Read in the requirements for a panhandle lot. He suggested that Mr. Soule add a note to the plan: no further subdivision of lots is allowed. Soule: Could come into the office tomorrow and add the note. Taylor: Looks like the size of the lot meets zoning requirements. McMullen: Motioned to endorse the plan. Seconded by Tubman. All Aye. 5-0-0 Other Business: 1. Discussion regarding the job description for the Town Planner: Henchy: Had spoken with Ms. Pierce and she requested a change to the job description that would add the following language: "to help the Planning Board if requested". Taylor: had no problem with the description as it stood Barnard: felt the credentials needed to be tightened up - is this a technical job -what kind of experience is required? Henchy: what about the job description for the clerk? With the increased hours how will the time be broken down and will there be enough time for both the Planner and the Board? Mr. Henchy asked the Board if they were comfortable with him talking with the Town Administrator about these issues. All Board members were ok with this approach. McMullen: Motion to adjourn.
