TOWN OF BREWSTER MINUTES OF PLANNING BOARD
Work Session
Wednesday July 2, 2008 7:00 P.M.
Brewster Town Office Building
Chairman Henchy convened the Planning Board work session at 7:00 pm in the Brewster
Town Office Building with members Henchy, Taylor, Pierce, Tubman, McMullen and Barnard
7:00 pm "Newcomb Knolls" -Letter of Credit
Present for discussion: Jay and Wendy Merchant
Ms. Merchant: reviewed and discussed the reasoning behind the Letter of Credit.
Barnard: questioned if there was enough time allotted for the Town to review and determine
if the Letter of Credit needed to be extended.
Henchy: felt the protection of Town was limited with only 60 days to make a determination.
He also questioned whether the Town would remember to check or if this would slide through
the cracks.
McMullen: Felt that if the Merchants would be able to lengthen the time for review it shouldn't
be a problem to accept as a form of collateral.
Pierce: agreed with McMullen and felt that the developer, the Merchants, had a stake in this
project and would get it done.
Henchy: Stated he would be comfortable if the length of time for the notification were 120
days.
Merchant: agreed and would just confirm with the bank that they were able to accommodate
this timeframe.
Other Business:
Doeg: Harrison Hill subdivision -The Board reviewed the Agreement & Covenant and noted
that a condition of the agreement was to a have a road report submitted from the DPW and
that no permits were to be issued until the report was filed and accepted. Therefore, it was
requested that a letter be sent to the Building Commissioner to stop issuing permits. Further

it was requested that the Planning Board Clerk continue to try to reach Mr. Doeg and invite
him to a regular meeting to discuss the subdivision road.
WORK SESSION
7:15 pm WORK SESSION - To review and discuss modifying the following proposed
by-laws:
1. Table of Use Regulations -Table 1
2. Home Occupations
3. Cluster Residential Development
Cluster Residential Development: A review of the existing bylaw occurred. The board
determined that a few changes were necessary in order to clarify the bylaw. The Clerk
will make the changes and re-submit.
Home Occupations: A proposed citizen's draft bylaw was reviewed and discussed. It
was agreed that in an effort to get a better handle on who/what the home occupations
were a "doing business as" list would be obtained from the Town Clerk's office.
Table of Uses: A brief discussion occurred regarding the existing table of uses. A
further look at the Accessory Residential Bldg. section needs to happen in order to figure
out how to deal with buildings that are renovated as apartments.
McMulfent motioned to adjourn. Tubman seconded.
