TOWN OF BREWSTER MINUTES OF PLANNING BOARD
WORK SESSION and REGULAR MEETING
Tuesday, July 22, 2008 5:00 P.M.
Brewster Town Office Building
Chairman Henchy convened the Planning Board meeting at 5:00 pm in the Brewster Town Office
Building with members Taylor, McMullen, Pierce and Robert Barnard.
Work Session
Present for session: Jon Witten, Ed Lewis, Dyanne Cooney, Joanne Hughes, Paul Hicks, Jillian Douglass,
Bill Porter, Victor Staley, Peter Johnson, Dave Carlson, and Chris Miller
5:00 pm WORK SESSION #7 - To review and discuss the following:
1. Water Quality Protection Bylaw
- A review and lengthy discussion regarding the revised bylaw occurred.
Modifications were suggested and noted by Jon. In addition, it was noted that the
Pleasant Bay Watershed should be addressed after this bylaw is passed. It was
agreed that we needed to keep the momentum moving and that the public would be
expecting something addressing the drinking water at the Fall Town Meeting.
Further it was noted that the Spring Town Meeting may be rather heated with
override issues and it would be better to address at the Fall Meeting. Also, it was
noted that all Departments needed to review and be given the opportunity to provide
their comments. Mr. Johnson felt it was very important to prepare the Town for this
bylaw prior to Town Meeting. He offered to send out a letter from the Conservation
Commission to help to educate everyone. Ms. Cooney felt that this was the first
piece in protecting our groundwater. Mr. Lewis would like to keep this bylaw moving
forward and wanted to make sure that the DEP, the Cape Cod Commission and that
all Departments reviewed these bylaws.
2. Earthmoving, Earth Removal and Excavation/Sand & Gravel Operations:
A brief discussion and review of the revised bylaw occurred.
McMullen motioned to accept the changes. Barnard seconded

3. Land Clearing and Grading
-Time ran out and it was agreed to hold another work session on Thursday, July 31St
at 5pm.

7:00 pm To review and discuss modifying the following proposed by-laws:
1. Table of Use Regulations -Table 1
-A brief discussion occurred and it was agreed that Jon Witten would help to revise
at a later date.
2. Home Occupations
-A brief discussion occurred. Mr. Staley pointed out his biggest issue was that a
home occupation is not allowed in an accessory building. In addition it was agreed
to increase the floor space to 499, delete the "net" floor space, and decrease the
number of employees to 2.
-McMullen motioned to accept the changes to the original bylaw. Pierce seconded

3. Cluster Residential Development
-A brief discussion occurred. Of primary concern was the fact that the open space
needs to be conveyed to the Town or to a nonprofit open space organization. In
addition, the Board wanted to modify the bylaw to allow an easement to be included
in the open space calculations.
Pierce motioned to accept the changes. Taylor seconded.

Regular Meeting
8:00 pm Long Pond LandingNVhidah Way -request to release 2 year maintenance bond -Susan
Ladue, Eastward Co.
Present: Susan Ladue
Barnard: Reported that he and Bob Bugle had been out the Whidah Way and done a road
inspection report. They reported the road is satisfactory.
McMullen: motioned to release the maintenance bond. Seconded by Pierce.
All Aye.
8:15 pm Other Business:
- Discuss letter from residents of AP Newcomb Area -request for no street light at the
new "Newcomb Knolls" subdivision
A brief discussion occurred. It was agreed that a street light was necessary to identify
street in the dark. It suggested that perhaps a light with a shield could be installed to
prevent the light from shining on homes.
Pierce: motioned to write a letter to Jay Merchant to install a light shielded if possible.
Seconded by McMullen. All Aye.
-Review/Approve Minutes for: May 14 and May 28
May 14th - a typographic error was noted. McMullen motioned to accept the minutes
with the modification noted. Seconded by Taylor. All Aye.
May 28th -McMullen motioned to accept minutes. Seconded by Taylor. All Aye.
